Item returns and exchanges policy

Hi mates, I've bought some shirts from this famous clothing company a few days ago because of its huge discount (via boxing day event). but as expected the small and medium sizes of the shirts designs that i like were sold out already both in-store and online. Out of desperation what i did was i bought the large sizes of the said shirts online instead thinking that i can have it replaced to the size i want in-store later on. currently, I have yet to hear the store's confirmation of 'ready for pick-up' of my order.

My question is, since the said shirt's sizes that i want are currently not available both and online and in-store will the store obligate me to choose a different shirt with equal or greater value? Or can I opt to wait for as long as it takes until the shirt size that i want becomes available in store? Any feedback that you can share will be much appreciated.

    i dont understand, they will either cancel your order if they have no stock of the large ones , or , have stock of them.

    they can not make you take a different shirt if you ordered one that they do not have.

    they do not have to give you a different size to what you ordered even if you ask nicely,
    they do not have to take it back if it is to big.

    it really depends on the store/person you get.

      OP did you even check the return/exchange policy. Most clothing stores allow you to exchange it for the correct size.

    • Hi thanks for the feedback. Ive checked the returns and exchanges policy of the said store. It seems like its pretty quite straight forward. They will exchange or refund the item you bought for any reason provided that the item is not worn and the price tag is still attached to the item.

    It is most likely Connor since it was on ozbargain a few days ago.
    I was able to swap to a different size if it is Connor.

      • In that case, your best bet is to call up a store you're willing to travel to, and ask if they have the size in stock first (Also tell them your story and see if they're happy to exchange).
        I was able to swap to a different size with no issues. (She did have to ask her manager first, but no issues with the swap).

        Having said that, the interpretation lies with the manager.
        For example: I wanted to buy beer past the best before date at a well known liquor store. The manager at one branch flatly refused to sell, claiming they 'legally' can't. I drove to the next branch and the manager allowed me to buy as many as I wanted. I kindly asked for a further discount since it was past the best before date, to which the manager obliged!
        NB: You legally cant sell things past a Use by date,

        Just remember to be nice about it, and to do it sooner rather than later. If you leave it too long, they won't have any sizes left/ change in season means old stock is harder to sell and they might not take it back

    They have no obligation to do so under Australian Consumer Law technically speaking, the goods you bought were as described, perform the function the product was supposed to provide and have no fault to them. (Your thought was to buy the wrong size to lock in that price, which is logical)
    However, most stores aren't going to kick up a fuss and usually if you are exchanging for the same item in the more appropriate size/you want to exchange the shirt for the equal or greater value, they usually are nice about it, especially big stores. Check the exchange policy of the store you purchased from, or even better, call up a physical store and ask if your size exchange can be done.

    However it may be a bit different if the sale is over (in the case of choosing a different shirt that may have a higher value, e.g. you bought a $15,000 car for $10,000 on a sale day, but you would like to purchase a $18,000 car, the dealership has no obligation to provide the same discount to $13,000 for the $18,000 car a few days later when the sale has finished, but if the car hasn't been delivered yet and you want a different colour which they have in stock in the exact same configuration of the one you purchased, you have a higher chance of seeing your request through although the dealership has no obligation to swap your bought car for a different colour)

    Actually, the shirt you bought was the shirt you wanted, paid for and received. It's not like you ordered small and received a large. So no, they're not obligated to give you another shirt.

I was thinking that may be i can reason out with them that it was a blind buy considering it was bought online and i have no idea which of their shirt sizes will actually fit me? or maybe perhaps i can tell them that it was a gift for me and the person who bought it assumed that my shirt size is small where in fact i am medium sized shirt person? i mean, these are quite typical mistakes of the buyer which i think the store will be quite considerate about it.

        They will most likely be accommodating to your request, however just don't go shouting "Under Australian Consumer Law" and "ACCC" because what you're doing isn't covered under it.
        Be nice and the staff should help you.
