LivingSocial Travel deal for Refund

We have made a purchase of this travel deal of $3799 last week and admit it is a little impulse when making a purchase. At the time of the purchase it saying a 1 day more remaining so I was thinking not straight and worrying might missed it.

https://escapes.livingsocial.com.au/set-sail-to-the-island-o…

Having discuss with family a little more about how I got into purchasing this and we want to ask for a refund because of the nature of the deal and the way it is advertise we might not suitable to go. At the time of the purchase it saying a 1 day more remaining so I was thinking want to get it and worrying might missed it. That available 1 more day is still pretty much there every single day past by.

So everyone realise that Livingsocial no longer have a contact number facilitate for customer to make enquiry? we tried to email [email protected] to ask for a full refund under their 2 day good deal guarantee http://livingsocial.com.au/info/guarantee.

The problem arise when Livingsocial taking a few days to reply and then refuse to refund because that deal is not part of Good Deal Guarantee. My family gone mad and angry at me for the purchase. Anyway, trying to solve this looking through their Livingsocial website. Their Good Deal Guarantee almost not part of any deal around and like a confusing banner that cause the customer to make wrong image that the purchase is refundable. I really do not know how they classify the deals that is with Guarantee.

Explained this and stick up with Livingsocial on the email a reponse from Livingsocial mention we can do a goodwill gesture refund but with 10% admin fee = $379 or Full livingsocial credit refund. I say $150 fee if possible but they trying to shut me out.

I kind of like to know what anyone think of this. Can we escalate further or anyway we can file a case we might can claim more back. Is this fair can we put a case to consumer protection? My family is suffer but admit I should never trust these website Guarantee or 1 more day remaining. Or take the 10% lost and never deal with these expensive purchase.

Has anyone have a similar experience and like to share how they classify the Good Deals Guarrantee deals to normal deals? I seriously cannot see a different to any deal as they all just look like the same.

Thanks

What is it with this forum today?!

    You 'impulse spent' $3800?! Wow!

Take the 10% hit and be thankful you've got a way out. Only other way is picking a date where they can't fit you in, which is unlikely.

but do you think our case is a little innocent as a customer? $380 admin fee is still like a steal from Livingsocial

If you paid over $3800 of your hard-earned without reading the Ts & Cs, without reading and refund (or lack thereof), black-out booking periods etc etc then sorry but more fool you.
Jees I read those booking conditions on a $20 restaurant voucher, I'd be extra scrupulous over a $3800 spend!

Only 3 months ago you posted that post, mentioning things like:

He demand to arrange activities which I feel finance strain as we are not great income earner (Honestly, he earn even less than me). I really don't want to go if he arrange these fullprice activities.

And that was over full-priced activities.

Dude, I really appreciate your concern. but this time is no a mate issue. its a family…

this deal is not a full price purchase, I thought we deserve a getaway holiday and not worry about others.

but it did not workout and just got worst as family argue about this doggy policy…

          @leehungfei:

What dodgy policy though? No change of mind, no refunds? Pretty common, especially on group-buying sites.

@Spackbace: But could you understand this from Livingsoical? http://livingsocial.com.au/info/guarantee when no deals are really Good Deals Guarantee

        • +1

          @leehungfei:

I straight away see the title:

          Local and Escapes Deals
For Local and Escapes Deals marked with the Good Deal Guarantee banner

No banner on the deal you purchased equals no guarantee…

You're trying to fish around for some sort of refund policy after purchasing the deal. You didn't find that Good Deals Guarantee from the deal page, because there's no links to it on there.

          Instead only this:

No need to worry about getting your preferred dates. The Booking Guarantee means that if you try to make a booking within 14 days from purchase and can't get your preferred dates in the validity period, you can get a full refund

So you bought something you do not want anymore I guess bad luck buddy.

Take the hit and be glad that they are allowing at least some refund.

You changed your mind. If all you lose is $380 over it, you are lucky. They could otherwise say "No refunds". Take the hit and move on.

Sorry OP but tough luck. You paid for something, didn't read the T & Cs so they are offering you a refund with a admin fee which is standard.

Learn from your mistake, take the hit and move on.

I say $150 fee if possible but they trying to shut me out.

Why do you think you get a say?

Always read the terms and conditions before you make a purchase. Especially such a big spend, $3800 is a lot of money. Own your mistake and move on. Don't blame LivingSocial for a poor decision you made. They have every right to charge you an admin fee for the time and trouble you have caused due to your change of mind.

You could look at the Lomani website and see which dates look to be fully booked and then request these dates so that you can get the refund based on the booking guarantee?

"No need to worry about getting your preferred dates. The Booking Guarantee means that if you try to make a booking within 14 days from purchase and can't get your preferred dates in the validity period, you can get a full refund"

"Booking Guarantee: Make a booking within 14 days from the date of purchase and if you don't get your preferred dates within the validity period of the deal then we will give you a FULL refund. Please note that evidence of an attempted booking must be provided to our Support Team via email no more than 2 days after the 14 day period. At this point, we will escalate with management to try and secure your preferred dates and if they are still unavailable, a full refund will be payable"

Long shot and not very ethical, but might be worth looking at.

P.S. I have actually been to that resort and it is quite nice (certainly for a romantic dinner), but if you are looking to do a Fiji trip, you can get a lot more for that amount of money - they can quote the enormous savings because they are including all the extras and the most expensive room type they have available. The Plantation Island resort on the same island is significantly cheaper (although used by lots of families) and you can always walk down to the Lomani resort for a dinner etc. Personally I'd recommend staying there for a few days/nights and then hopping to another resort on another island.
