Legal Rights on Faulty Product under Warranty

I bought a coffee machine from Kogan which is faulty under warranty.
They don't sell it or an alternative anymore, so they offered me a store credit to its invoice value.
At the end of day, I just want a coffee machine.
Is a store credit sufficient under law or am I entitled to a refund?

  • You are entitled to refund, repair or replacement. Refund means your money back, not store credit.

  • Yep, they won't mention a refund to you, but if you ask them, they should do it no questions asked.

  • Is Kogan covered under Australian Consumer Laws? I thought imported items are excluded from ACL?

    • It's their own branded product.

    • I'd argue that they are covered by Kogan under the ACL. Kogan's Australian website is the means in which the product is sold. They don't have a Kogan HK website which is separate. This means that they are specifically targetting Australians and intermixing Kogan AU product with Kogan HK product. Effectively, Kogan AU is acting as a selling agent for Kogan HK.

    Why is there so much hate on this site for Kogan?

    From my dealings they seems no worse, or better, than 95% of companies.

    Compared with Horrible Norman and Tricky Dicky, Kogan are the good guys. lol

  • Got the full refund. No hassles.
    Surprised how quickly Kogan approved it & provided the refund - within 10 days of the complaint the money was in my bank account
