Megabuy - Dodgy Practices

Ordered a HDD from megabuy. Website showed one in stock.

Got an email two days later-

Hi xxxx, last unit has sold out.
We won't be holding stock due to price rise.
$32.01 payable if you wish to proceed with backorder.
Please call us with card details to proceed.
If you wish to cancel, please email back - response required in writing.

As you can imagine I have told them where to go.

  • That's very dodgy, they're able to source more but won't give it to you for the price you paid. It seems like they even agree it's not a price error.

    The Megabuy "Terms and conditions" doesn't mention anything about them being able to change the price on you:

    The other page that's a fun laugh is their "About Us" page which describes how they are passing the savings onto you. Check out their use of bold font:

    I don't know what your experience was like but if you have grievances then start with trying to resolve it with Megabuy first. If that doesn't work out you can raise a complaint with the ACCC explaining the price increase.

      Order Acceptance Policy

      All orders placed with us are subject to our acceptance. We reserve the right to decline (i.e. not accept) any order up to the point of the point of delivery of the order to you and an invoice for the order being issued to you. We will not dispatch an order until we have received payment in full for the total value of the order. Automatic confirmation of successful order placement and/or receipt and/or processing a payment for the order does not constitute acceptance of the order by us. If we decline your order after a payment for the order has been received/processed we will contact you with the details and refund the payment in full.

      However, they shouldn't take your money if they did not have intention to sell it at that price, that would be "Wrongly accepting payment" according to ACCC. A bit hard to prove that they did it intentionally though..

      Could also be considered "Bait Advertising" based on info on Fairtrading NSW.
