I have recently purchase an iPhone 5S it been restore to ISO 9. However is still asking for the previous owner login detail is there a way of getting around it I try contacting the seller without any luck.

Never, never, never buy a second hand Apple phone unless it has been completely reset to factory default and you know it has been removed from the previous owners cloud and iTunes accounts. Apple has set all this up to make it easy to "brick" a stolen phone. I don't know how much detail you have on the previous owner but I would send him an SMS telling him that if he doesn't contact you that you are going to the police as you suspect the phone is stolen.
Sounds like the iCloud lock aka 'Find my iPhone' is still turned on and registered to the previous owners Apple ID/Account. Only way around this so that you can use the phone is to get the previous owner to turn it off.
Oh dam, so there is noway of having this fix :(
