Damaged item during warranty claim

I bought a gearbox for a small motor, and when I plugged it in there was clearly something wrong with it on the inside (clunking noise as it operated)
I sent it back to the online store I bought it from for a warranty claim, and in the return process the packaging got damaged and the corner of the gearbox housing has been damaged, the store I bought it from is refusing a warranty claim because it was damaged in shipping.

I feel like the superficial damage has nothing to do with the performance, but I can understand where they are coming from.

do I have a leg to stand on? should I insist they return my item? or just cut my losses and buy another?

    When receiving anything with damaged packaging take pics immediately.
    Retailer is correct… no liability, unless it is obvious that they did not use sufficient packaging. You could have purchased shipping insurance.
    The responsible party would be the shipping co.. but without that initial evidence success is unlikely.

      My understanding from OP is that the packaging was damaged when the buyer sent it back to the seller. Not when the buyer received it.

    • I received the product in perfect condition
      but when I turned the product on found something internally wrong

      so I sent the product back to the supplier
      during shipping the product was damaged (superficial scratches on surface of casing)

      now the warranty is "void"

    You really should've taken pics showing it in perfect condition because unless you make a claim with whoever you sent i back with then you have no leg to stand on.
