I have an unused unactivated Windows 8 OEM CD that I bought it from PLE a long time ago. Apparently there are some rules that go along with selling these like it has to be sold to certain people or with a computer/hardware… still not really sure how it works. Can I just chuck it on eBay by itself? Thanks.

What a great answer. I love this place, the first response was detailed and related exactly to the users specific issue. Compare that to the dross you have to wade through on just about any other community site.
Just sell it to someone else who is a system builder and you're in the clear
sell it to me, I just built a computer and need the OS.
wasn't aware people still bought OS off ebay anymore….too many scammers with fakes (not sure if windows 8 had the same issues with MSDN keys- fake keys that would work for limited time)
even if you did manage to sell to someone
they could just come around and claim it be fake and ebay will support the buyer
sure you will get the goods but but you probably will receive back a damaged/opened/used goodsIMO - too much plausible/possible headaches
better off just fobbing it off locally thru facebook to friend of friend or stash it for your next computer (or even your relos)
MSDN keys aren't even the worst. I've come across people selling Volume License keys with 100 uses to people and Microsoft doesn't find out because it doesn't reach the activation threshold and go through the automated phone system.
You can sell it. Windows 8, as a different product from Windows 8.1, actually had a different set of licensing rules! You could actually buy win 8 OEM products from a store even without purchase of any hardware at all, because MS added a “Personal Use License” allowance.
This was reverted in Windows 8.1 where they once again, made it a violation of the EULA to sell it for personal use:

Not that anyone cared!! Yes, many pc shops like PLE or PCCG did abide by this rule and only sold Windows to you if you bought a piece of HW, but it doesn't neccessarily mean that you could get in trouble for buying only the OS without any accompanying hardware.
