Should I Return Samsung Phone under Warranty to Kmart or Samsung?

Hi, my friends Samsung galaxy s3 is in a constant boot loop. Got it from Kmart about 20 months ago so still under warranty. What's best course, taking it to Kmart or calling Samsung?

Still have receipt.

Hasn't been rooted or anything (thank god).

Call Kmart and ask them first.

I agree with fishism007. I would never taken anything to Samsung for a repair.

  • your point of sale should handle warranty's.
going to the manufacturer should be a last resort , unless you have a Samsung store super close by.

    • Either is ok

      • you lose ALOT of your rights if you go the the manufacturer.

"you will only be entitled to recover costs from them, which include an amount for reduction in the product’s value"
" You cannot demand a repair, replacement or refund from the manufacturer."

        https://www.accc.gov.au/consumers/consumer-rights-guarantees…

and the value loss of a phone after 20 months is pretty step.
now most retailers will still refund/replace, but they do not have to.

  • Got the receipt?

  • I bought a bose hifi soundlink at Myer but been ask to contact the manufacturer direct. They refused for any exchange…

    • I'm not expecting them to exchange it, just to handle dealing with Samsung.

    • https://www.accc.gov.au/system/files/Warranties%20and%20refu…. it is a breach of the fair trade act them telling you to sort it out directly with the manufacturer. Assuming it is within warranty and you have a receipt.

I'm not a lawyer though so do your own research before you do anything.

    • Passing on responsibility for a remedy to a manufacturer Because each sale is a contract between the buyer and the seller, consumers are entitled to insist that the seller provide them with a remedy, even if a problem is due to a manufacturer’s fault. It is a breach of the Act for sellers to mislead consumers about this right – for example, by claiming they can do nothing and that the consumer must contact the manufacturer for a remedy.

  • Kmart will accept product returns and provide you with an exchange voucher, refund or repair where:
The product is faulty or is not of acceptable quality, or
The product is not fit for its intended purpose…

I think it'll be fine if you just go back and ask for a replacement or refund at Kmart.
I've experienced buying a faulty 3DS from Target once, I got it replaced under the 7 day return policy. Hopefully Kmart has something like that as well

    • 7 days < 20 months

oh geez, I have no idea how I misread 20months as 20minutes… My apologies

Got it from Kmart about 20minths ago

        • :p fixed

  • Under aust consumer law the retailer is the point of return for any product that becomes defective and needs warranty repair.
It is the best way to solve a problem with a faulty product as you maintain your rights, you don't have to pay shipping either way and if it gets lost in the process then you are covered.

  • Go Samsung as Kmart would be sending it back to Samsung(QSL in Sydney) for repairs. Kmart would be the middle man and it take longer for your warranty to process.

  • If it had been less than 12 months ago that you'd bought it, you could simply return it to Kmart for a full refund of the purchase price 'on the spot'; by law. Which would obviously be the best option because then you could simply buy another one with a new full warranty begining from that date, or by sommat else, or buy nothing (take your cash and walk) etc.

However, it's been 20 months… so I assume you are referring to a 'manufacturer's warranty' that Samsung has specified, of 2 years? In which case Kmart may not even be obliged to have anything to do with the return of the phone (apart from verifying the receipt of course).

That's my understanding anyways; if anything electrical 'spontaneously' becomes (demonstrably) faulty within 12 months, you'd be mad to do anything OTHER than simply take it back to the point of sale and get your money back for it, then and there. After 12 months though, it's not as clear cut.

In my opinion, please go to Kmart and speak to them before you try Samsung out. Read the above link about the warranty service nightmares from Samsung.

I assume you tried a factory reset? In my experience bootloops are software problems.

  • Yes, I believe Kmart (POS) best; then postage/courier etc is their responsibility. As previous poster suggested doing a reset (factory settings) may/should eliminate your problems; probably what Samsung would do first anyway.

I currently still use my S3 (unlocked) from Vodafone; it was a free upgrade phone from the S2 on the Red $40 plan (I pay $35). I have had no problems with either phone. I believe i may be just out of 24 month contract. Vodafone sent me an email a few weeks ago saying they will give me the S4 (or similar) free if I sign up to the better (unlimited) Red $40 plan, and an extra 1GB if I do so by 29th. I may ask for a further $5 off etc. I may also ask for the S5 (currently a $10 per month). We really like these Galaxies; son chose the Mini2 (for his jeans pockets) and Mother the TtendPlus. No problems with any. Check their website for. phone alternatives if interested

  • Hi OP. How did you go with your phone problem. Did Kmart look after you?

    • I got it working for her. And then it died again, same thing. Then she bought a new phone. Women? Am I right? Eh? This guy gets it (points into the crowd).
