Selling House - Corrupt Agent?

I have accepted an offer on my house sale which is well below value on the condition my agent continues to market the house until contacts are exchanged.

Contracts are still not exchanged after 5 weeks and there has been no open days in 5 weeks despite asking for this.

I was suspicious so sent two anonymous enquires via realestate.com.au and my agent replied the house has been sold despite the fact contracts are not exchanged.

Is this illegal?

    Get a new agent.

    he probably has his own investor who he sells below value. If no contracts have been signed i would be withdrawing it from sale and getting another agent.

      Yeah, i.e. himself. What's the bet that 'coincidentally' one of his relatives or a close friend ends up being the buyer?

    Go to your agent and tell them you are dumping them, also tell them you are reporting their behaviour to the relevant authorities.

      • Rate up their with used cars salesmen. Not all but a lot. Same playing field and i could never be either. Trust neither.

        They always say that they will look after your interest, but when offers start coming in and it doesnt meet where we thought it would be fair value, they will pressure you to sell asap just to close the deal. If you are really looking out for my interest, you will either go out and negotiate hard for me or assess if we should hold on a little longer for a better offer to come by. This is just by own experience, im sure others will have their own story to tell.

    Our RA told consistent untruths and failed to disclose significant information about the house, but heh I wouldn't expect anymnore from an RA.

    As above get a new RA, and get important agreements documented.

  • No deposit yet, I cannot trust this agent after lies but I need to sell.

    • No point complaining then. So many of them to choose from nowadays. If you let them, they will take advantage of you. If you told them you need to sell so desperately, this is where your trouble would have started.

    You sound like your own worst enemy. YOU accepted an offer that was nowhere near what you wanted, YOU think you cant the trust the agent but don't want to get rid of him because without him you can't sell your house. Have you seen the market lately? Put a sign out the front if you have to and do it yourself. Stop crying about digging your own hole.

    3. 5 weeks later you still don't have the contract signed

    There's a lot wrong with this story and it isn't just the agent
