PayPal Question - I Think I've Been Fleeced

Hi Guys,

I've sold an item on eBay and sent it to the buyer. There is evidence that I have sent the item.

The buyer paid via Paypal.

A week later, I've got an email from Paypal advising that the transaction in being disputed by the customer with the customer's bank.

Paypal has applied a negative amount equal to the item value in my Paypal account.

So, my worry is, that despite me being able to prove to paypal that I sent the item, I, as the seller, will still be forced to wear the cost of the chargeback - is this correct?

It doesn't seem fair - the Credit card transaction was between the customer and Paypal - if the customer is being fraudulent (Which I believe to be the case) then why should the seller have to wear it?

I only wish I could speak to the Buyer's bank and show them the evidence.

  • Out of curiosity, did you get the email from PayPal stating 'safe to send' or 'seller protected' usually in green writing.

    Or did you get a PayPal e-check.

  • I experienced the same situation in Feb 2014. After they looked into for 1-2 weeks PayPal gave me back the money.

    • Yes, same here, but it took just over 4 weeks. The annoying thing was that my PayPal account went into debit so I either had to be out of pocket for 4 weeks or not use PayPal.

  • i had a situation with a quilt cover i had sold.
    Buyer claimed they had not received Paypal held the funds i gave them the tracking number
    showing item had been carded after unsuccessful delivery i call Paypal they closed case in my favour
    straight away.

      similar situation - sold a small item, sent it, buyer left feedback stating "item received, happy", then 2 weeks later non-receipt dispute. paypal asked for proof of delivery i.e. tracking number, but as it was a small flat item that went in an envelope for 70cents I had no proof. paypa; ruled in his favour.

      this same buyer had 5 recent negs as a seller for demanding money after selling an item and then not posting.

      useless paypal.

        After 3 disputes this year I've started sending everything with signature on delivery. Not worth the hassle of disputes! Seems to be on the rise??

          Yes, I agree, we have to be careful and protect ourselves. On another note, I would consider buying insurance on sending quite expensive item via aust post for value up to $100, just pay $1.50 extra.

          I recently lodged a missing parcel enquiry with AusPost and found out there is no compensation for signature on delivery even though the back of the AusPost ebay satchel clearly states automatic cover of $100. I would have been better off paying $1.50 for extra cover instead of paying $2.95 for signature on delivery.

          The new satchels no longer write that as the postage options have changed.

          ==Old System==
          The satchels (both 500g & 3kg) used to be FREE, and you had to pay postage through Auspost "Click and Send". Insurance was automatically included.

          ==New System==
          The satchels are NO LONGER FREE. You have to buy them. Postage is also no longer through "click and send" and instead you pay and print directly from ebay. Insurance is NO LONGER included.

    To make things even funnier, when the buyer inevitably wins, you will have to pay back the item cost, the delivery fees the buyer paid, AND you will have to pay a "chargeback fee."

    PayPal is a ****ing joke for sellers. Beware.

  • Did PayPal state the reason for the dispute eg. Goods not receive, Not as described, Unauthorise transaction, etc?

    • Already done that. No response. They've made their feedback private.

      Not only that, they were zero feedback when they bought and paid for my item. I even got a message from them saying "I'm new to eBay, can you please leave me feedback" which is what I promptly did.

        Contact paypal, show them you posted it and try and find out what is going on.

  • I had the same issue sending 154 oil paint tubes, apparently 2 leaked and without any photos OR posting them back paypal voted in the buyers favour, and I lost $500 in paints, paypal protection yeah right ! Stupid.
    Even if you have a warning in the listing saying that you're not responsible for lost OR damaged items, the buyers just say they never got it, OR it was damaged. WE ARE the customers not the buyers, we pay the fees most of the time.
    MAYBE We should quietly create a list people that DO STUPID THINGS, I'm sure in a year we would have an awesome database to cross check with with.
    If you notice they buy something you can just tell them it's lost OR damaged, then cancel and refund. Simple.

      What on earth makes you think you can absolve yourself of that responsibility? You're selling a product and receiving money. It is the buyers responsibility to get you the money, it is your responsibility to get them the product.

      Otherwise I could buy from you and say "I am not responsible for lost OR damaged payment" and then tell you the cash I sent you was lost in the mail, but it's not my fault…

      Until the goods get in the hands of the customer in the condition they were sold in, it is your responsibility.

  • It sounds like they're claiming an unauthorised transaction. Ask Paypal to compare the address you have sent it to, with the one they have on record. If it's going to the account holder's registered address it would seem pretty obvious what conclusion they SHOULD arrive at.

    • Thanks - I'll try that. I have ten days to lodge my case, so at the very least I can delay it that long before paypal has it's way with me

    Just to clarify I'm not a shop I just sold some stuff in the garage with my 9 year 100% rating Ebay account.
    I do understand where you guys are coming from with respect to the buyers perspective but I'm not sure it is totally 100% my responsibility if the item was lost/damaged by someone else when I gave the buyers 3 choices for postage, either standard uninsured , insured and tracked/signed & insured.
    So far one phone was lost in transit ( the buyer didn't want insurance and I lost that case ) and the paints I mentioned before where apparently only 2 of 154 had "leaked", so they got them ALL or FREE , how is that fair ? I'm sure you guys would also be pissed at that too.
    The choice of convenience & risk is up to the buyer to make. Its almost like saying you don't want to pay the cashier 15c for a shopping bag at Aldi… then demand a FULL refund if one of the eggs are damaged on the way home. I know it's not the best analogy but just trying to get my point across that Paypal needs to actually investigate better, possibly get more details from each party not just the 50 words or less whatever it is.
    Photos / Videos and returns should be compulsory in a refund regardless otherwise people just keep on buying stuff with no insurance then get it all for FREE ! Clearly not sustainable.

    What I do now is I actually take a video of the item going into the letter and then into the post box.
    For anything over $30 I get insurance regardless if they paid or not.
    Not sure if paypal will accept the time stamped video as they don't even spend any time investigating the issues, they probably have some untrained staff that spin a wheel and decide who was at fault.
    Protection should be provided to all people involved here !
