MS Surface Pro 3 Website Advertising at Prices below What They End up Charging in The Cart

I went to the Surface Pro 3 Australian site advertising the essentials bundle at $AU 2078.98 incl Gst which should include a surface pro i5 256gb, a keyboard and a docking station. When I actually clicked in and selected the items, the cost came up to $AU 2158.98 instead.

Live chatted with the online sales representative and her supervisor who would not honour the advertised priced on their website. They came up with the lame excuse that the lower price coming up for the Essentials Bundle only reflected the price of the surface pro 3 alone. Please note that the RRP for a Surface Pro 3 is actually $AU 1849 but they were trying to come up with the explanation that the price only reflected the price of the Surface Pro 3 and they had also put the wrong price in!

They insisted that the correct price was that displayed by the cart and was under no obligation to honour the lower price.

This smacks of false advertising by Microsoft. What stops anyone then from advertising at a lower price for the bundle and then charge us extra when we actually go through the process of purchasing it?

Is this illegal and what can I do to hold them accountable?

  • Looks pretty illegal to me! In the past I've always threatened companies to take them to the ombudsman, but never had to follow through with it, as the threat is normally enough to get Justice done. So, start with that?

  • I'm unsure as to which Ombudsman I would need to contact. The difference is $80 but I really dislike what they are doing and how they basically came up with a bad explanation and stuck too it. Their website still reflects the lower price on the essentials bundle.

  • $2078 is the price I get when I add them all separately with the student discount. I think they're advertising 10% discount but really it's $150 off, definitely try and get them to come down to advertised price seeing as though they sell it to students for this price.

    Or just buy it as a student if you are/know one.

  • This is commonly known as a pricing error. So there is nothing illegal going on here. However, if it's your opinion that they have violated your rights by not selling this item at a certain price. Then you have the right to contact your state's consumer affairs and file a complaint.

  • Decided not to buy the Surface Pro 3 from Microsoft due to the way they dealt with the matter,

    Bought the HP Spectre 13.3" x360 13-4007TU W8.1 Convertible 2-in-1 for $1,343.16 as Dick Smith was selling it for $1599 and had a 16% off promotion. Ordered the Dell digitiser pen which is compatible for $41 (with a coupon).

    All up very happy with my purchases and MS did me a favour by having such poor customer service and standards!
