Rebel Sport 10% Price Beat Guarantee

After seeing that they offer this (saw it tonight on a TV advert) i thought i would surf their website to check out what they have to offer (product wise). One thing led to another, and had me searching for their pricing guarantee.

I had a good look in their T&C's and the closest i could find that came anywhere close to a "price beat" was……….14.2.2 You acknowledge that we are not required or obliged to match any prices for any Products, including matching any prices for a Product that is available through the Site at our store or vice versa.

Surely this has to be against consumer law.

Like they are promising one thing in main line advertisment, but turn around and contradict themselves in their T&C's…… unless i am missing something.

Can anyone offer some advice.

Cheers

  • I'd be interested in sticking it to rebel sport. Their markups infuriate me.

  • Wouldnt this be the same case as certain other stores, ie. Masters having opening specials and people here complain that other master out lets are not matching those store + 10% off.

    • No, this is not store specific as this policy is across all stores.

Just to make sure, i have just gotton off the phone to one of their stores, and its confirmed that they do price beat by 10%.

      But…..,they wont beat online traders.

And here is where i am chewing the fat. I have found an online trader selling New Balance cross runners that i like, at a really good price. Free shipping for orders over $100. My purchase will exceed $100.

Now, if RS have no information in their T&C's on this price beat policy, how can they enforce the "no online trader beat" verbally.

      Cheers

      • They can enforce it by not selling it to you? Any one has the right to refuse selling you things…

        • Any one has the right to refuse selling you things

Not in South Australia. (taken from SA fair trading act.)

          PART 6 - RETAIL TRANSACTIONS

Limited offers and failing to supply as demanded

          1. (1) A trader must not advertise or offer goods for sale by retail upon
condition that no more than a specified or limited quantity or number of the goods
may be purchased by any one purchaser.

            Maximum penalty: $2 500.

          (2) A trader who offers goods for sale by retail must not refuse or fail, on
demand of a quantity or number of the goods and tender of the appropriate price,
to supply the goods in the quantity or number demanded.

          Maximum penalty: $2 500.

        • @coin saver:

Hmm not exactly sure if that act is 100% relevant to this case. I see that as a store refusing to sell me 10 pairs of shoes and only allowing me to buy one pair. That is quite different to completely refusing to sell you anything.

If that act does apply and business' have absolutely no right to refuse service/sale, then basically one could go into Hungry Jacks, demand to buy all their meat patties (so they have none left) and they legally can't refuse to sell it to you. Or you could be a nuisance, be rude and insulting to staff and other customers and the business can't refuse to serve you.

        • @JLove:

          a quantity or number

          One is a number.

          If that act does apply

Why would the act not apply?

Or you could be a nuisance, be rude and insulting to staff and other customers and the business can't refuse to serve you.

I am sure if you are legally removed from store you would have no legal right of purchase and would not be there to make said purchase in the first place.

  • What did the TV offer actually say? Did it refer you to their T&Cs?

People have alluded to the Rebel Price Beat for years but I can't find anyone who has ever found anything that was written down.

NZ Rebel actually has it on their site: http://m.rebelsport.co.nz/shopping-online/price-guarantee

But nothing on the Aus site.

    • To be honest, i only caught the commercial in passing. That said, i will be watchfull when/if i get the chance to veiw it again.

    • FYI Rebel NZ and Rebel AU are not at all related.

I've never heard of any sort of price beat from Rebel AU, lowest prices are not their target market.

      • Physical stores only, staff have to check its the same style and with stock on hand at competitor.

        • Is this documented anywhere (for public or staff)? Or is it discretionary from store to store?

        • @the-mal:
I can't seem to find it anywhere, from memory though if you get put on hold, it's on the pre-recorded message along with the "gift cards are a great gift if you cant decide on a product" and "can't take it home today, put it on layby" messages.
I'm not sure whether it's 5% or 10% price beat.
