eBay Seller, Claiming out of Stock Because Sold at Cheaper Price

I purchased the Cheerson CX-10 drone for $10 when it was listed at $10 from seller "bobowaytoway". The seller since then has changed the price to $24.39 and communicated to me that they are out of stock. They keep insisting that I accept a refund and reorder the item (probably at the $24.39 point)

When I ask why are still selling it even when they say they are out of stock, they ignored the question and just told me to accept refund. When I said I could wait for the next shipment of stock, they said they do not know when it would come and ask for me to accept refund again. I once again told them I could wait, then they said they got the answer and said it would take 2 months to get new stock. So I said I would wait the 2 months. Then they replied that after 2 months, eBay would cancel the order and told me to accept the refund. They are clearly lying about the stock level and just want to get out of fulfilling the order.

Are they allowed to do that (telling me that its out of stock just because I purchased it at a cheap price)? And what should I do, should I just accept the refund?

    Open an ebay dispute then neg the pants off them! They wont like the neg feedback but there is not much they can do about it!

    • How do I go about opening the dispute, it only has contact seller from the drop down menu. Sorry, never really had this bad experience with eBay before.

      They get around 13 a day, but not much else you can do.

  • I doubt this company will worry about a negative comment. 300+ in the last month. They won't do crap for you, just file a dispute and get your money back.

      still neg, they have 311 negs this month and are below 99% on feedback. If it drops low enough it affects their fees etc, every little bit helps! To report the listing look for the link just below the 'good guys' advert. You will have to choose from some drop down boxes that wont have your exact problem but choose the closest available.

      You could try and write to them telling them that you will report their listing and neg them unless they honour their original sale. I used to be an eBay Powerseller and i would always buckle to something like that but then again I wasnt selling something that cost 50c to buy wholesale for nearly $25 retail.

    Yes and give them a neg. Nothing else you can really do and it wouldn't be worth the $15.

    • I actually purchased 5, so it around $75 saving :P. Thought it was a good buy as gifts. But it was sold out before I could post it.

  • Don't wait too long, I waited for a "second" item from an Indian seller because the first didn't arrive and because the date was I think 60-90 days when I tried to claim a refund PayPal refused stating that I waited to long. The item was like only $2 but if you don't lodge it you could lose it

    It could have been PayPal or ebay that I lodged with, but it was a few years back
