Can I Return My GTX 970 from MSY?

Hey guys

I bought a GTX 970 from MSY on 12/02/15 to use for my quad monitor setup but with the huge "memory configuration" problem at the moment about it that NVIDIA seemed to kept hidden until exposed, makes the games I run with resolutions 3840x2160 work fine for a moment then starts to freezes and frame drops every now and then.

I looked around and it seems that the culprit is the memory, since when I reach the end of 3.5GB and use the 0.5GB memory with lower speed, the game struggles with it.

But you can choose a refund or exchange if an item has a major
problem. This is when the item:

• has a problem that would have stopped someone from
buying the item if they had known about it
( I didn't know about this bug until I have to google fix for my problem)

• is significantly different from the sample or description
( GTX 970 box states 4GB VRAM but its actually 3.5 and 0.5)

Two dot points in them point out to my problem.
So I can return the card or not? what you guys think?

  • Technically you can't because you got the whole 4gb as described (although it's what you thought it was) but I'm pretty sure if you pressure them or just ask nicely they'll gladly accept it.

      He's bought the card with 4gb all at the same speed not 500mb clocked lower then the rest.

  • I don't know about Australia but Amazon have been giving refunds for 970s like hotcakes ever since that has been revealed. Worth a shot I reckon.

      • So windows system information state that the GPU has only 3.5gb ram?

          NVIDIA Site, GPU Box states that the GTX 970 has
          "4 GB of DDR5 VRAM" with speed of 224gbps BUT in reality upon close checking of reviewers, its actually the
          3.5 GB Vram has speed of 150gbps and the remaining 0.5gb runs at only 20-50gbps

          after reaching 3.2 - 3.3gb of vram it slowed down, compare that in game and the game would stutter and freeze.

          so its actually just 3.5gb 150gbps and 0.5 50gbps Vram.

  • Just take it back. It is NOT working as intended. Case and Point.

  • This memory issue has been acknowledge by Nvidia for awhile now so if OP did his research he would of known.

    • It's MSY who are the experts, so if there is a strong chance the purchaser may have known, it's almost certain that any dispute panel or court would therefore accept that MSY should have known. It would then depend on what claims were made regarding the devices capabilities, and what it's "normal" use would be.

      I'd suspect it would be MSY [and other stockists] who'd have to tough it out with nVidia if it came to a formal ruling. I feel for them, but $550 is just a bit much for sucking it up :-/

  • Any word on if you returned it? I am feeling the gripe of the 3.5gb now in Witcher 3.

    • Yea, I was able to.
      Complain what your problem is without saying any knowledge about the 3.5gb vram…

      • Did they ask for a video of the issue as they asked me for one.

        • No, I just said, I'm playing a game that requires the "said on box 4GB Vram" (eg, Crysis 3 or Witcher 3)
          and my game would stutter and lag when reaches the threshold of 3.5gb.

          but you should be able to since, its not what it says on the box of gtx 970

  • I've gone back through my retailer and they've said that Gigabyte are willing to give me a free game to resolve the matter. Either Batman or The Witcher.

    I think that this is a load of crap because I'm assuming they already have a bunch of keys sitting around for these games because of their current promotion/offer which is running til 17 July, them giving me this game to resolve the matter is at no real cost to them (in my eyes).

    I already own both games and I don't believe that them offering me something (which is probably at no cost to them) is resolving the problem.

    Should I play hard ball and tell them that giving me a game doesn't resolve the issues I'm facing and that I'm seeking a full refund, part refund or discounted upgrade to a 980 or 980 TI. (all of which I've seen cases of on various forums overseas and locally).

    Any advice would be appreciated.

    • You are completely entitled to get a full refund on the product. Accept nothing less. The product was falsely advertised and does not deliver what was promised. There is no wiggle room or negotiating to be done. Just take it back for a full refund and if they don't, then go straight to the office of fair trading in your state.

      It's an issue to be taken up directly with the retailer too, by the way. No need for you to have to go back to the manufacturer.

      • If the retailer gives you any BS about it or tries to shunt you to the manufacturer, just remind them of what happened to MSY & HN in the past few years …the ACCC took them to court and they received $100,000's in fines for breaching the Australian Consumer Law. They were telling people that it was between them and the maker (it's not, you enter a contract with the retailer only) and that certain problems were not covered by warranty when in reality, if you'd known it wouldn't do what it was bought for you wouldn't have bought it.

  • I bought mine from Amazon and I could not be bothered returning it because I would have to pay international shipping fees to America. I only use 144 Hz monitors, so the card is fine at 1080p. 144 Hz 1440p monitors are too expensive, so I probably won't be upgrading anytime soon.
