Yes, I have had claims rejected for that exact reason, but have also had other successful claims. It just depends on who takes up your case and how they interpret the T&Cs.
HN sale price is until 31/1/15 so no problems there.
Just went into the good guys to use the price guarantee and found out HN is now $595 and OW is $548.

Can you not return it (assuming you haven't opened the package)? Not sure about TGG but some other retailers (eg. Big W) allow you to return within 30 days if you change your mind.

If anyone is interested, there is one left at the Nambour store in QLD. I had to take back my Canon 1100D as it was DOA out of the box, so I swapped it for this Nikon deal. The photo lab guy mentioned that there was another one, and even he was surprised it was still there.
