Optus Is Screwing Me

Hey guys,

So like many of you I was excited by the Sony Z3 and PS4 offer through the various telcos. I however before signing up for the pre-sale contacted the optus sales support team over the phone first. I was then told I would be well within the first 100 Infact I was sent an email by the staff outlining the details of the contract. And If I wasn't receiving a Ps4 I could cancel when another member called me up to confirm the details of the contract including whether or not a ps4 would be received. That call never came, phone was shipped (a couple weeks late infact)

After much run around with optus I was offered 3 months free or the option of returning the phone within a few weeks after deciding for a bit. I've now been charged for those 3 months. Have been suspended and am a little worried It may affect my credit rating (not that worried).

I've made a post on the facebook page asking that they contact me through facebook because the first time around I spent over 6 hours on the phone with them over two days.
Wouldn't mind some support if you could (Y) like my post. It's a good read if you ask me.

      Not to be rude, but the grammar of this post is horrendous… I'm not sure if the person said that you could cancel the contract if you did not get the PS4, or if the contract stated that.

      • Sorry it wasn't clear. The person told me, that someone would be calling me to confirm the details of the contract after a period of time (as the period of time at that point was a PRE-sale) and I could confirm with that person at that point in time whether or not I would receive a PS4. If not, I was free to cancel. As to the post, just randomly wrote it up after checking my mail and I had a letter stating I had been suspended for failure to pay my bills. Probably should have proofed it at some point.

        • Hmm..As the other person said, you may want to contact the TIO if Optus does not resolve it, as there's probably some sort of misrepresentation involved, which has influenced you to enter the contract.
          On the other hand, because a written contract was given to you, outlining the details of the contract, signing the contract even without reading it means that you intended to be bound by those terms. This means that by the parol evidence rule, anything said prior, that was not stated in the contract, cannot contradict anything written within the contract.

  • Do you think it may be worth going to an OPTUS store. Not sure if you may get some assistance there. If you have no success. I am sure that if you take the issue to the ombudsman, or maybe even just mention the ombudsman to OPTUS staff, they may be more helpful. Good Luck.

      thanks for that. didn't really want to be threatening just wanted to show how peeved and ridiculous this has been. From experience with other telcos the store can't help much they usually just give a number to call. and if it's anything like telstra's may not even be corporately owned?

      • I understand that you may not want to be threatening. You don't have to be. You can politely advise them that you are not happy and that they have left you with no other options. You can also get advice from the ombudsman before you request that they action your complaint against OPTUS.

  • If it went down the way you said it did, ask for a copy of the recording when you signed your contract, if they said what you say they said then you have a leg to stand on. If it was all speculation and you read into it to much then you may be screwed. Either way get the recording and that is your evidence for a case. By law they must provide it if the contract was established over the phone.

    Telco salespeople are usually always private sales co's that are not associated with the telco. They will tell you any lie under the sun to get you to sign up. Lots of businesses do that.

    Learn the lesson and move on. If it is not in writing then it wont happen… dead simple law to live by.

    BTW… I made the mistake of taking a new phone on contract with optus many years ago and that deal had a 2 mth free period. Optus applied the 2 mth free period twice.. I didn't complain LOL. At the end of the contract they screwed up again where there was a nice credit in my favour. Telcos stuff up, they do, but sometimes it can be in your favour.
