9289 - POOR customer service

Hi,

Well I was one of the 'lucky' ones to order an MSI Wind blue netbook that came with the free monitor last Thursday (http://www.ozbargain.com.au/node/17067)aimed at OzBargainers. Unfortunately what a lemon this has turned out to be!

I ordered the product when it WAS in stock (Blue MSI Wnd + monitor), paid for it straight away via Direct Deposit (as I didn't want the CC surchage), receive an email confirmation acknnowleging my order (all last Thursday) , then now I get an email just today (Tuesday) saying that they have no stock in at all, yet they have my money and can only refund me! I ordered this fair and square and to get messed around like this is ridiculous!!!!

I rang them and they faulted their own stock system saying that ‘it’s not the best’.
Not only this, but someone purchased ‘all’ of the netbooks just before I did and I’ve missed out.
Apparently I should ‘ring them for updated stock info’.
It apparently ‘doesn’t matter what way to pay’ ie. Credit card or direct deposit doesn’t matter.
(All of the quotes were exactly what they told me on the phone today).

Why can't they manage to ALLOCATE an item when you order it? How hard is that? And what about possible limits as to how many you can order also? It sounds exactly like a COTD thing really.

It’s not all about not getting the items, it’s also about NOT having the money for over the weekend and few days as it could have been used for something else or even gained a small of interest!

This 'bargain' was specifically aimed at us OzBargainers, and legitimate people like myself fair and square placed an order and deposited the money only for them to sit on it and nearly a week later inform me that they're not in stock anymore??? Come on…

Congrats to the people that actually did manage to secure themselves one (if anyone).

  • i also bought the msi wind with the monitor. im currently up to step 2 out of 5 in the order process. it says payment has been confirmed. i also paid with directdeposit due to the CC surcharge.

  • If the money has gone through and they accepted, the contract of sale has been made. You could harass them etc.

    PS - please direct further complaints about the site at forums.whirlpool.com.au

    • From the Dell fiasco, paying by Direct Credit is not "consideration" in the legal sense.
      Both parties have to agree to the deal, only when consideration has been made and accepted (this is the crucial word) is a contract made.
      9289 must confirm your order (ie accept your consideration) before a contract is made.
      It sucks but there you have it..
      Bad luck on the deal, but the good news is, the higher Aussie dollar should see more deals like this into the future.

  • i've just been sent an email that the item is awaiting dispatch (step3). so i guess i was one of the lucky ones who bought it in time.

  • im sorry you missed out and got stuffed around, but i think suggesting that 9289 has "poor customer service" is an exaggeration.

    i have placed many orders with them and have found them to be both extremely helpful and friendly. i cannot fault them in any way.

    this was a genuine limited bargain and with the mad rush these kinds of stuff ups were bound to happen.

    I have never dealt with them but they seem like a good company:

    • often offering free shipping
    • good prices apparently
    • deals specific to ozbargain
    • many replies on ozbargain last week about a future special and asking us for feedback
    • offering good deals on ozbargain

    What more could you want?
    Ok, their system didnt show that the item was sold out and you thought you got one. tough luck. it happens. They are offering you a refund (which of course they have to).

    I think this line sums up you will not take a reasonable approach to this:

    If purchasing the laptop meant you had little/no money in your account, you should not have bought it.
    If you are worried about the approx 42c (I am guessing, say $500 @ 5%p.a. for 6 days), then you need help

      No picture this - most of us have limited incomes and allocate money to various things - now if I had of KNOWN that I would not receive the netbook do you honestly think I would have purchased it in the first place? Not only that, but I made a significant purchase over the weekend and had to juggle my funds, as believe it or not, there are people in this world with finite incomes and only have limited amounts of money per week for spending. Not only this, but I have also had another difficult experience with 9289 before and it took a considerable amount of time to obtain a refund from them, as believe it or not, I ordered printable CD-R's and received silver ones instead. If a company messes you around twice with you, wouldn't that leave a bad taste in our mouth? I gave them a go the first time, and now after this episode I am dubious of dealing with them again.

      I have voiced my opinion about it all, but the next time someone gets mucked around by them (or COTD or anyone else), then all I can say is "I told you so". I have asked for a full refund and await my money.

      • Totally agree aldog that its not good enough. You were obviously excited to have gotten through and for them to withdraw the offer is unfair and would have been very dissapointing and upsetting.
