What Should I Call This - Lucky or Unlucky

Well… thought of sharing an experience with you guys and you can decide if I am lucky or unlucky…. Long story, No TL;DR . Read only if you have time. Don't blame me please….

There was (and it seems still on) a promotion from a big company (don't want to name) who was giving away around $3500 worth their product through a lucky-draw. Last week, I used their product and got a voucher. My son was there with me and I gave the receipt and voucher to him as and asked him to keep it in the receipt box when we reach home ( i usually account all the transactions daily or alternate days). It was an online voucher and he asked me if we were going to participate. I said yes, we can enter and we drove home (End of scene 1)

last Monday my wife got a call when she was at work and the lady called was asking for my son. Wife was a bit surprised when caller introduced herself and couldn't understand the relation of their product and my son. Then the caller said xxxx has won a prize worth $3500 and would like to talk to him. Wife said he is at School. The caller asked how old he was to which my wife says 8 years. A bit of silence for a while…. and says 'sorry, this is meant only for 18+. How come he got to submit the entry for the draw. I am afraid, as per our policy, we will have to take back whatever we offered. We will try to see if we can give it to you or your husband but no guarantee and we will let you know'. Wife finds herself in a situation where she was welcomed with red carpet, greeted and seated and then was told 'get lost' (or in OZBargainers terms a deal was published and we all jumped on and paid for it just to know that the deal has been cancelled and it might take 2 weeks time to get your money back to account). My wife calls me and gives the whole story along with some add-ons (end of scene 2)

I got back home and asks my son 'My dear young man, what did you do with that receipt and voucher'. Without even looking at me he says 'nothing, receipt is there and voucher I entered online'. I said 'OK, thanks for that, but whose details you used?' . He replied 'Well, I know you have been taking lotto for a while but didn't get anything, right? I thought I am luckier than you, so I put it on my name. Dont worry, if i got it, I will give a portion to you'. I said 'Great, thanks dear, well… you are lucky indeed. But not that lucky to be really lucky. You won but as you put your name with school email and mom's phone, i am afraid you are not going to get it, I am sorry'. I told him the whole drama happened on that day. There came a dead silence and then a long lasting cry….(end of scene 3)

Now a quick question - is there any chance I can claim that? I contacted the company and they said they will try but cant guarantee because as per their policy its for 18+ only. Its with their head office now for final decision. Have you guys ever experience this situation? A bit funny but disappointing as well esp, when I see my son is sad at what happened. Is there any chance, even remote, to get it?

I know its a long story and thanks for reading it (if you are on this line reading it from top to bottom :) )

EDIT: I called the company's office and they said its with General Manager to take a decision. They will let me know by 2-Dec. Lets see :)

    The answer to your question is that if the T&Cs state that the prize in non transferable, and the winner must be over 18, then you're out of luck (they have no obligation to give you the tickets). Beat the child and move on with life. :)

    i dont think they can legally give you the prize as the winner is under 18 and they would have to redraw it, its not really a matter of if they want to give you it , its illegal , and they would get a fine much greater than 3500$.

    The Dad used the product, and obtained the voucher.
    His son entered the info, i think there's room to move here if the company decides they want to.

  • Its been said above, but if the terms of entry state that the prize in non transferable, and the winner must be 18+ and they do have it in writing that your son is the entrant (who is under 18 years) then you lost the prize yourself. Life lesson.

    • Most of them have in the T's & C's (which ironically can stand for something else…) that if the prize winner is under 18 the prize can be transferred to the parents/guardians. Would like to know what competition so this legal eagle can go through it for you
