    haha snatached one, though i wasnt even prepared that it would come out! it helps to log in prior to the sale. the 5 minute holding period is soo much better than COTD, though the bait and buy tactic is pretty sneaky. still prefer the ps3 slim though but wee is cheap frills.

    awesome, got the ps3 the other day, and today got the wii from this site!! i had to click on the wii twice, the first time it said i was too slow for yesterday's sale, for some reason.

    i can't believe people are calling this site a scam…clearly a number of us actually got our orders through, and I have ordered plenty of things off 1-day before with no problems. I think it's a case of sour grapes

    • yeah i think so… well technically we haven't received it yet i guess, but all my orders have been received in the past so I'm reasonably confident these will come through too. Although I've never ordered anything quite this expensive from them, so it'd be pretty annoying if they didn't :P

  • Guys, there is a rumored price drop of $50 for the Wii in the states. Come Christmas, I'm sure some retailers will be burning up cash to bring us the Wii for $199. Those buying this deal will overpay by $8 for delivery muahahaha!!!

    • The problem is, the head of Nintendo has no interest in dropping the price of the Wii seeing that people still snatch these off shelves. I mean the DSi is $300.. my goodness that's a lot of money for what is essentially an underpowered device with two 0.3mp cameras, and the DS lite is still hovering around $200 years after its release.

  • Honestly, losing some money by selling only few units (< 10 maybe?) at under cost price but, getting the Click through and hype talks for the site is just CHEAP marketing really!

        This type of "Bargain" that is sold out in a matter of seconds is totally pointless .
        It is starting to become a blight on this website . But i gues you have to pay for server traffic like everyone else .
        The only winner is the perpetrators of the website that see hugely inflated traffic At the expense of the loss on a very limited number of units . Of course you already know that but you asked so I've answered .
        This is akin to Viral marketing but not so clever and very transparent .

          I don't see how it matters whether or not the item is sold out quickly or not as long as people had a shot to get in on it. This was the case for the PS3 and the Wii here. Just because you missed out doesn't mean everyone did.

          The complaint seems baseless, and even if people did miss out they at least now know of this site and can subscribe to the newsletter to improve their chances in the future.

              @cyssero: If 5 people get it it's about as good as all those bargains people post where a single store only in a nation wide franchise is offering a deal. How many of those do we see? "Store XYZ in state 123 has half a dozen gizomos bellow cost". 95% of people here likely have no shot in hell of getting one but people don't seem to mind those.

              Honestly it's not uncommon for deals to be posted where stock is very limited. If you aren't into these kinds of promotions/sites why keep following them and leaving yourself disappointed?

              At least everyone has a "chance" with these online ones rather than state or store specific deals.

              This entire sites purpose is to "advertise" products. As above, several users DID get the console and you can only assume that people that don't visit this site also got in on it.

    I'm waiting for my chocolates, too :( their site really sux, I ordered two under my account, one under my name and one for my friend in Sydney, now they have both been posted under my friend's name (since that was the last purchase) but under our different address! and I have mine as the company address, with 800 people in the company, I doubt I will see it :( sux!!!

    despite making this order on Friday and sending them an email that afternoon, they were unable to 'fix' this up for me!!!

    won't buy from a hopeless company like this again

  • you all do realise 1-day.com.au sends out an email 10 minutes before launch telling everyone whats for sale? I dont see why the stocks are allocated if hundreds or even thousands of potential customer sits infront of the computer and click BUY NOW at exactly 12pm?

    My chocolate arrived earlier this week with great packaging, no trouble at all, mind you im in WA. So those of you that have not got them, go blame AUSTPOST not 1-day.

    Here is a quote from the ACCC factsheet on bait advertising which I think would apply for these types of websites:

    "What is ‘reasonable’ will depend on the type of product on special and the length of the sale—a reasonable supply of dishwashers will differ from a reasonable supply of tea towels. It may also depend on how the sale was advertised and the previous sales experience of the trader. For example, it might be reasonable for an electrical appliance retailer to have six refrigerators available for a special sale, but unreasonable for a clothing retailer to promote a special sale on socks if there were just six pairs available."

      That entire quote is full of ifs butts and maybes and you've overlooked the part discussing both how it was advertised and the nature of previous sales/how the store trades.

    1-day didnt heavily promtoe their sale. i didnt know they were selling a ps3 or even wii till i read it here.

    Plus everyone knows the store is all about quick turnover of three items per day so dont expect it to hold stock to sell forever.

    Its a concept store based on one simple concept…here are three items for sale today only and once sold out its sold out, thats it….pretty simple.

    Definition: The Trade Practices Act 1974 (the Act) contains rules that prevent ‘bait advertising’—advertising of certain goods, often at special prices, primarily to bring customers into a store without sufficient stock to supply the sale goods.

    "A statement like ‘WHILE STOCKS LAST’ may seem innocent enough, but it may
    be considered bait advertising if you don’t have sufficient stock to cater to the likely
    demand your advertising will bring"

    • Sure "while stocks last" may not always carry a lot of weight, but youre pretty much comparing this sale to one that may be held by a major retailer like Kmart or Harvey Norman or whatever.

      Theres huge differences such as the store being one that is only designed to hold stock for a max of one day and the fact that the advertisements were only sent out to subscribers and only 10 mins or so allegedly before the item was even on sale. Everyone who received that advertisement would have known how the sites run, the nature of the sale and have a rough idea on what stock would be like.

      As with the deal the other day (PS3), no one here also knows how much stock they had to begin with either.

      based soley on first come first serve idea.

      We all know this, we all expect this and we are all adult to understand what we are getting into when we visit such sites for a highly sought after items.

      Plus as robost as the Trade Practise Act might be, it was written in 1974….did legislators back then have any idea about email and the world wide web ?

      Its a new wild west of competition and opportunties, just got be quick on the draw. ;)

        Since people are throwing around the TPA without citing, allow me to. Under the Trade Practices Act 1974 (Cth) s 56:
        (1) A corporation shall not, in trade or commerce, advertise for supply at a specified price, goods or services if there are reasonable grounds, of which the corporation is aware or ought reasonably to be aware, for believing that the corporation will not be able to offer for supply those goods or services at that price for a period that is, and in quantities that are, reasonable having regard to the nature of the market in which the corporation carries on business and the nature of the advertisement.
        (2) A corporation that has, in trade or commerce, advertised goods or services for supply at a specified price shall offer such goods or services for supply at that price for a period that is, and in quantities that are, reasonable having regard to the nature of the market in which the corporation carries on business and the nature of the advertisement.


        It is important to note this is a question of fact, not a question of law; which basically means the decision is based on the circumstances. The Act stresses "reasonable having regard to the nature of the market in which the corporation carries on business and the nature of the advertisement".

        Now, the market of these sites is clear - they do cheap, dirty and quick deals. This is emphasised by their advertisement only appearing 10 minutes before sale time - rather than a week in advance like your typical realworld retail store.


        Also, bargrin, don't let the assent date of The Act mislead you. Section 56 was amended in 1977, 1986 and then 2001. :)

        • Seen as though you sound like someone who know a bit about the TPA - can anything be enforced when buying from a company not based in Aus? My gut instinct says no, but a learned response is always nice :D

  • bait advertising, or otherwise, its clear that 1-day are pissing potential customers off. whether the frustration is justified is beside the point.

    the simple solution is for them to be very clear about the limited nature of their stock. why not just front up and say exactly how many are on offer at the advertised price? they will still get all(/most) the traffic and exposure, but people who miss out won't be shitty.
