eBay item past estimated delivery date and still in transit - What should i do?

Hey guys,

I purchased an Nokia Lumia 920 during Ebay's 15% off promotion. Got the phone for a great price and the seller had a good rating:

Unfortunately, it's been well over a month since purchase and more than a week past the latest expected delivery date and I've received nothing.

The product is tracked but it only shows up until it leaves China on the 28th of October. There is no information from Australia Post, just the Chinese shipping company. It's been in transit since the 28th.

I contacted Australia post to see if they can provide me further information but they could not see anything I can't and suggested I wait until Wednesday (today) before getting the seller to launch an enquiry.

I initially asked the seller for a refund but he refused. I'm sure I can get my money back via pay pal but i'm thinking if i get a refund and if the phone does eventually show up i'm going to lose the 15% Ebay discount when i repay the seller.

I guess I could wait until the absolute last day before opening a Pay pal claim (45th day). Does anyone have any suggestions on how i should proceed?

  • I read somewhere on Ozbargain that the paypal terms have changed. If the item does not arrive within the specified time, a refund will be issued if a dispute is lodged and that's the end of it. Not 100% if it is true though

    • The change won't be retrospective.

      OP, let it go for another week or so, and if it still hasn't arrived then, just file a dispute. Mail from overseas DOES take a while sometimes, and on the odd occasion that I've been in the same position I've just left a respectful note to the seller in the comments section stating that I'm aware of this, and am just filing the dispute within the claims window, and will cancel it when the item turns up.

  • Hi Jesho, mine turned up on the arvo of the final day of estimated shipping time (16 days total). I'd actually emailed them that morning because my tracking was saying exactly the same as yours…they got back to me pretty promptly, suggested I give it a few more days as China post is not the fastest & had been known to take up to a week longer…but if I were you, and it hasn't turned up, just to cover myself I'd be opening a dispute on day 44 (give yourself a day's grace in case you forget).

    Contact the seller though & let them know it hasn't arrived yet, just to cover your bases. They were bragging about all items shipped being fully insured, so at least that's another layer of protection for you.

    Once the Paypal dispute has been decided in your favour, seller cannot reopen it irrespective you receive item or not.

    Get your money from Paypal and that's it.

    Given this "shipinsurance" they are guarranteeing delivery or money back.

    OPEN a dispute with PayPal it takes some time to resolve, so if the item does arrive you can cancel the dispute and the seller gets paid.

    If you dont open a dispute within 45 days (Check this as its from my memory) you cant dispute the delivery.

    Yes you might lose your 15% discount, but what would you prefer? Lose the lot or lose the 15%.

    It's Nokia so you probably will find the will be 15% cheaper by the time this is resolved.

    Just relax. If it still hasn't arrived when the paypal dispute window approaches, open a dispute on the 44th day. The seller will have some time to respond, but if it still hasn't arrived you will get your money back.
    I don't understand other commenters who freak out about delays in China post shipping. Everything is slow, but it almost always ends up arriving.
    If you get stressed by the wait, pay the extra for a local item, but don't add costs to the Chinese sellers by filing disputes early.
    Consider it from their point of view, in order to get the sale they need to use the absolute cheapest service options, or you will buy from somebody else, so to then file a dispute because the delivery was delayed is harsh.
    For the record, if I had bought an item from China in the 15% off deal, I would be expecting it this week, based on past experience, and there is still 2 weeks till the 45 days is up.

      It's probably worth bearing mind that it's not so much the speed of shipping that is disconcerting, it's being given a point to point tracking number that basically says "Nanjing: Item dispatched" for up to several weeks…yeah, being patient is most certainly a virtue, but it's only human nature to worry. ;)

    Mate if it shows up as leaving 28th October then it hasn't even left yet. Be patient.

    But seriously if you mean left by 28th September, then 17 days is NOTHING. Really. I've waited more than a month before.

    Average is more like 3 weeks minimum.

    I wouldn't even bother contacting the seller yet. The estimates on ebay are rarely correct. Give it at least another week, then give the seller a chance to correct the situation, THEN if there's no joy PayPal dispute.

    file on the 44th day, and paypal dispute process allows another 2 weeks-1 month for resolution.

    if it arrives in that window - WIN
    if it doesn't, dispute already in place - WIN
