Red light camera..

(Not sure if this should be in automotive but anyway..)

So I think I might have gotten snapped by a camera, but I was in a little bit of an awkward spot.

Car A was in front of me and had completely entered the intersection to turn right and was waiting for oncoming cars to stop. I was partially in the intersection (over the pedestrian crossing) also turning right. Oncoming Car C went through a yellow light so by the time the car in front of me turned and I started moving the light had just turned red. and I think I saw a camera flash. Is there any chance I can argue this if I do get a fine? Or should I not have been in the intersection in the first place or just stayed awkwardly partially in the intersection? Was alone in the car so no witnesses unfortunately.. Sigh.

    As long as the front set of wheels are over the thick white line, you're ok.
    Also, there might be a slight chance the camera has malfunctioned. I've seen occasions before where the camera flashed but there were no cars in the intersection as it flashed

    • same. seen malfunction flashes too often. but then, take it as a lesson if walk free this time.

    If you have ten years clean driving I would suggest you apply for a pardon. Otherwise you will probably have to pay.

      They will not waive red light fines.

  • It doesn't matter if there were people in your car, as we all know whose side they will be on.

    You are suppose to only go out a little bit if you are turning right as to not impede any traffic when the light changes, so if the light does change you don't have to go through the lights

    So Car A is in the wrong if they have completely entered the intersection.

    I know everyone does it, it doesn't make it legal though.

  • If you're already over the white line I think you should be ok, as you are suppose to be partially in the intersection when turning right with no green arrows and you cant stay in the middle of the intersection.

  • Isn't it funny how we all have such different views of road rules.

    My understanding was that - assuming we are talking about the dropped red arrow at an intersection here - there can only be one car in the intersection waiting to turn right at a time. That car is allowed to travel through the intersection on the yellow light, or yellow/red if the oncoming cars are still coming through the light, as they are not allowed to remain in the intersection during the light change for traffic travelling in the other direction. However, as there can only be one car waiting in the intersection at a time, any car behind them, would be considered to be going through a red light.

    Just the way I understood it though.

  • Depending on size and layout of the intersection two cars can easily enter the intersection waiting to turn right. Hell, sometimes three cars can. The only time you should not do this is if the road you are turning right into is already blocked up with traffic.

    When the lights change both MUST turn the corner. You never just sit there in the intersection. You cannot be fined for this. The red light camera needs to take two photos, one showing where you were at the moment the light turned red, and another showing you in the intersection after that.

  • Australian Road Rules regulation 61 seem to apply here.

    Subsection 1b specifically outlines your situation (if there was an arrow, otherwise 1a applies) and from my reading you shouldn't have an issue provided you entered the intersection on a green, and exited the intersection on yellow/red as soon as safe to do so.

    tl;dr Probably ok, provided wherever you were adopts this road rule.

  • If you have entered the intersection on the green light and are over the line and the light turns red, your ONLY option is to go(unless there is no one behind you in which case go back a bit…
