Advice for returning a good of unacceptable quality

Yesterday I purchased a Wii U Premium pack from Kmart using the substitution deal (and I thought I was lucky). However, I've discovered that the package has had quite a bit of wear and tear (smudges and scratches on the GamePad/console) as well as some wear and tear on the box itself. As well as that, the AC charger for the GamePad is missing. The AC adaptor for the main console wasn't even tied together with the length of wire all tangled. It's quite likely that this Wii U was purchased by someone else who then didn't put all the parts back into the package (deliberately or not) when he/she returned it.

However, I can't exactly prove that this was not by me. I'm thinking of filing a comment of complaint to Kmart, but I'm not sure if I'm still eligible for a refund/substitution, although their returns policy does say that they do accept product returns where the goods are of unacceptable quality. I do still have the receipt, but I'm not sure that's enough.

    you should be fine, usually they are very understanding.

    simply walk up to the service counter and ask for a refund.

      Well… maybe not a refund… Maybe ask for a replacement when another comes in. :)

    I would say that statement would get K Mart into a lot of trouble if it was true?

  • As much as you may think you are in the wrong, you aren't.

    This said, it is a "Your word against theirs", but you are their customer and should try and keep you happy as much as possible so they can get further business from you.

    • Generally speaking they will be fine with replacing it or doing a refund.
      Unless you start off the conversation pissed off and rude, then they will just be rude back to you.

      It is always pays off to be polite and nice.

      Although knowing Kmart and Target, you should REALLY check what you are getting before you head out the door, quite a lot of times things have been stolen or used before. Especially with these Wii Packs you maybe missing the Red Card (registration card) in the box.

      People are stealing the Mario Kart Registration Cards as they give a free game when registered.

      However if you are in Melbourne, I don't mind to purchase it off ya for $179. lol.

  • The Australian Consumer Law trumps Kmart's policy anyway.

    Kmart are bound to replace, repair or refund anything that doesn't fit the brief.

    • Yeah, but you have still have to prove it wasn't you who did it, don't be an idiot going in there yelling about consumer law to someone at the help desk.

      That's the fallback plan.

  • I'd just take it back as soon as possible and ask for a refund or a replacement.

  • If its missing stuff, take it straight back. Its in their policy and guidelines for staff that if it is missing stuff, they will swap it for another one or find the parts it is missing and give them too you.

    Sounds like it was the one on display. We used to show consoles at our store, but if we sold them it would be at a lower price (which you got it for 240$ less so I think that fits the lower price part lol).

    You shouldn't have any problems. Just don't forget your receipt. If you don't have that, there is nothing they can do.

    Bring the receipt.

    • Nah it wasn't on display (they had the Mario Kart one on display and that was just the display box), it was the one out the back.

  • Well anyway, I went back and got my refund (kinda wish I got a replacement but seeing how they were sold out before, it wasn't likely to happen.

      Shoulda 'refunded' it to me…. instead of getting a refund from Kmart. lol.
