I bought a wii fit u package that was 'like new' on ebay for $100. Received it and all was good except the pedometer that comes with it has a destroyed screen
The pedometer costs $30 to buy alone, the package cost $35 to be posted
I told the seller and they said they will refund $15 or return the whole package at my expense
Do I have any choice here..? I could have paid an extra $30 in the first place and bought a brand new one

The seller really should cover return cost.
Just so you know, if you do open a case with Paypal, you will have to pay to return - by a trackable option.
I don't want to return it as it is a big hassle plus the board and game work fine.

Unfortunately even in law, you can't expect to receive full cost to replace with a new item if the item you received is 2nd hand. You could only expect to receive it's 2nd hand value.
Even if there are no 2nd hand ones available? :( Just annoying because I didn't pay for a board+game and broken pedometer
Doesn't matter. The item is 2nd hand, you're not entitled to value to replace with a new item only the depreciated value.

I don't believe it was damaged in postage though is the thing. It was in bubblewrap in the middle of the carton in it's own cutout so would of been very difficult to damage while it is in the box. The box had no damage to it/not bent in or anything. There also were no pictures of it in the listing

if that's the case he is scamming, just return it and don't buy anything that is not pictured in good working condition. you can get 3kg extra large express post bags for the same price as a normal 3kg- you have to ask they are behind the counter
That'd mean returning the whole package though and I'm happy with the board and game, just the little pedometer, be out of pocket for nothing. They have given me the $15 refund will just keep an eye on ebay for a cheap one.
