Who gives way in parking lot?

Hi,

I'm curious in a parking lot scenario, you are driving towards the exit and there is a driver reversing his car in front of you. Who should give way in this case? If the other driver reverse too fast and hit you, who is at fault?

I never knew what to do, normally I just slow down and if the reversing driver continues, then I stop. I can't recall learning about this in RTA learners handbook.

    I pretty much do the same thing as you. I never trust other drivers. Too many times I see people turn without indicating or not turn when indicating etc. The main road rule I follow is my own, try not to get hit or hit other cars. It's worked so far. Only problem I've had in 15 years of driving is a lady hit my car while it was parked recently…

  • Carparks are normally private areas not governed by regular road law per-se (unless specially applied for that carpark… Think Westfield vs a council carpark).. They are also full of idiots who do stupid things behind the wheel - especially when the carpark is choked up a bit. I can only imagine that an insurance claim would be a real headache.

    Therefore I follow the law of common sense. If the car is reversing out, let him come out. If a car is screaming up against the arrows to try and snatch an elusive carpark, give him the bird.

      A lovely police officer once told me, private area open to the public = normal road laws.

    I believe the car parked gives way (sort of like coming out of a drive way), however if that car is already in the middle of the road reversing, then give way. If that reversing car hits you, Im pretty sure if their fault. Never assume any car will stop, whether you're the one reversing from a car or the one on the road.

    In all car parks… drive slow and watch out for everything!! … trolleys, kids, people reversing while texting, the ignorant, the impatient, … etc..

    Who gives way to who?… There is no set law.

    Just avoid accidents…

    Best advice my father gave me when I was on my learners; if you slow down, the other driver will always take their chance to get ahead of you. If you keep the same speed and not show any sign of letting them out, they will wait for you. If not, then it is their fault for reversing into you.

    Based on road rules the a vehicle that's reversing must give way to all oncoming traffic. So since your driving on the main carriage, the vehicle reversing will be at fault.

    I can't believe that people are talking like there would be any doubt in this case! If they are reversing they must give was to ALL traffic.

    • Given that there are large support columns in multistory carparks that create large blind spots, it's wise to assume that someone who is reversing out of a car spot cannot see you and is likely to keep coming out.

    And now I'm scared how many people are not sure or think that they should'n give way to everyone when reversing.

  • There's a simple way to avoid reversing into a car- reverse park at the first place.

    • But it's often more convenient to park head-first in a shopping centre car park, if you're buying lots of groceries. Having your boot easily accessible would be the reason most people park head-first in cases like this, I'd say.

  • If the driver saw me before reversing, I push forward beeping politely and swerve round them as they hesitste. If I've approached while they're reversing , I give way. Obviously I avoid getting hit.
