I feel like I need to share my personal experience shopping with Sydney-based Ozzytyres with you.
I made an online purchase for a set of four tyres last Christmas to have them delivered to my residential address.
After 4 months of non-delivery and sub-standard customer support, Ozzytyres informed me two weeks ago that Startrack Express had made a mistake and delivered my tyres to Donnellans Box Hill, a fitting partners of Ozzytyres located in Melbourne.
To put an end to this debacle, I decided to go to travel to Donellans in Box Hill to pick up my tyres in person. The manager at the store demanded that I pay a "release fee" of 40$ a tyre. I thought that was outrageous and explained to him the situation. He made it clear that he's aware of the mixup but was adamant that I can't have my tyres until the fee of 160$ is paid. Ironically, that's how much they would charge me to have the tyres fitted (a service which I did no require). He blatantly admitted that they are there to make money. My attempt to reason with him was futile. I made a call to Ozzytyres to make them aware of the situation but the person looking after my case was conveniently on lunch. Of course I refused to pay the fee and left my tyres with Donellans Box Hill. The store manager even threatened me by saying next time I'm back he can't guarantee that my tyres will be there.
I have contacted ACCC prior to the event of yesterday and have since seeked advice from Consumer Affairs Victoria and filed a formal complaint against Ozzytyres with NSW Fair Trading.
I understand that Ozzytyres have a responsibility to fulfil the terms of our contract which is to have the tyres delivered to my nominated address.
My beef is with Ozzytyres. But having people like Donellans Box Hill and their questionable business practice doesn't help. I never voluntarily entered an agreement with them to have my tyres stored in their warehouse for 3 months. In fact with my proof or purchase for the tyres, isn't it illegal for them to withhold my properties from me?
I know that Startrack express has them on record for taking delivery of tyres that were addressed to me.
I think at this stage I've done all that I can to purse my rights. But in case anyone planning on doing business with Ozzytyres and Donellans Box Hill, hope you will consider my experience and think twice before forking over you moolah.

Did you pay with credit card? You have a claw back period of 3 or 4 months. Contact your bank immediately to find out when the cut off is.
It works the same way as a paypal dispute. Give evidence that you never recieved goods, and communications with seller.
Personally I think you should only be taking this up with Ozzytyres. They are the ones who should be chasing the delivery guys, in turn will chase O'Donnellans.
(As last resort - Small claims tribunal is only like $40-50 to submit application)
