Dick Smith extended warranty issues

Hi

I purchased a tv from Dick about 14 months ago with extended warranty. The on off switch has stopped working and generates a buzzing sound. TWG (warranty company) have agreed to send a gift card for the original price of the tv. That's the good news. However they don't believe it is now their responsibiliy to dispose of the tv which could cost $200 to take to the tip.

Also I still have just under 2 years extended warranty purchased left but there will be no refund of that. If the tv had been repaired I'd still have the remaining warranty period but with a gift card refund I lose that. Ideally I think I should get a pro-rata refund.

I'm I being picky or are these valid points?

  • Leave it out on your nature strip the next time hard rubbish collection comes around your area?

I don't see a problem on the extended warranty being lost. From memory if you total your car, once the insurance company pays out your policy that's the end of it, even if its just a day after you renewed. And like your case, if they repair the car the policy continues on as normal.

  • Honestly, imo. you are asking too much for the first part(dispose the tv). just wait for the annual kerbside collection to dispose that tv.

with the new tv, you are getting a new 12 months warranty. so, I think you have ended up as the winner here.

You shouldn't have needed an extended warranty to get a 14 month-old TV replaced by DSE - it didn't last for a reasonable time. Your discussion/argument now should be with DSE, not TWG, who seem to have done the right thing in this case. IMHO, DSE should provide a free three year extended warranty, if you spend the gift card on a replacement TV from them.

Seeing as you still have the TV, why don't you take it in to DSE now with your receipt and see if they will repair\replace it? Don't mention anything about the extended warranty….

Full refund + new TV sounds mighty tempting ;-)

This. Extended warranties are irrelevant these days. I can't wait for someone to be bothered to go to court to argue that if a business is offering extended warranties then that must mean there is a reasonable expectation that that the product should last for the period of the extended warranties being offered and therefore the statutory warranty should apply.

I notice a few companies have picked up on this and no longer offer extended warranties but additional 'services' such as phone support etc.

gee, a wonky switch doesn't sound too hard to fix

Hopefully you now realise that extended warranties are scams.

    Few options:
Exercise your rights under the COMPETITION AND CONSUMER ACT 2010 - SCHEDULE 2 ("Australian Consumer Law")

    https://www.accc.gov.au/publications/consumer-guarantees-rep…
This is a simple, easy to use brochure it's free to download or even order a printed version.

The on off switch has stopped working and generates a buzzing sound.
    It's the power supply.

Take it back to Dick Smith, tell them you want a full refund. If it's unreasonable for you to return the item, they must pick it up.

These rights cannot be excluded by law. It is against the law to mislead you about your rights or to charge for something that is already covered under these laws.

Bring the brochure, it's worked for me at an Apple store.

Last, my local council offers twice yearly household junk pick up service.

Thanks for all your responses. I think another visit to DSE may be in order and maybe even an attempt to get the tv fixed.

    • I wouldn't. If you have been paid out, then getting it fixed is akin the theft. They requested you dispose of it not keep it.

Put it in the classifieds? (as in a free give away) Obviously explaining what is wrong with it.

I'm sure there are people out there who would take it off your hands to have a tinker with it for their own satisfaction. Win win if they manage to fix it. TV is off your hands for free, they get a new tv for free?

Seems awfully wasteful and sad to toss it out without giving it a chance to be recycled by someone who might find some use in it.
