eBay buyer opened a dispute over Jalapeno ASIC miner

Hi,

I got a buyer opened a dispute saying that the Jalapeno ASIC miner that I sent him was DOA. I took a screenshot from my mining pool graph before I sent the item to him. That is the only proof I have that it was working.

What should I do? Please help… I'm worried that this case can favour in buyer's hand. I have a strong feeling that he is fraud. If I ask him to return the item, it may not be the same item that I had.

    If your buyer is 'smart' and is really trying to commit fraud…….Let me just get this over and done with for you:

    Yes Yes, I know Paypal says blah blah proof delivery this and evidence that, it's all bullcrap, all their decisions are automated. Your best possible outcome is Paypal forcing the buyer to return the product to you (likely purposely sabotaged) at your expense.

    You can appeal all you want, but post their decision they treat you like a criminal and red flag your account, hold your funds hostage and ask you verify random payments that go into your account for no reason, under the guise of 'you have been selected for random checks', when that's not true at all.

    You're just lucky the buyer didn't do the ruthless thing and go straight to unauthorised payment, where you'll lose both the product and money within 20minutes, with no chance of appeal.

    Google this stuff on the net, and you'll find to the book cases similar to yourself.

    • The fact is, this is the internet. Things like this happen, sadly. Maybe it was poor shipped and it is defective. Who's to blame? Cop it on the chin as a cost of doing business, just like retailers have to deal with theft or poor employees etc.

      Buyers always win.

      • Yea really sad, I wasn't even doing this as a business just trying to sell something to get some money back. I paid extra on shipping to cover insurance. But how could I blame the postman if it was already accepted? Does second hand item from non business have the same warranty / consumer protection as a brand new iteM?

          Check with the PO. They may ask you to sign a declaration that the goods were in good working condition. You paid for the insurance (hopefully not under-insured) so I say go for it.

    I rencently had a similar issue via Paypal.

    Buyer sent item back not in original condition. (had to return for refund)

    I complained to Paypal, they ignored my complaint and closed in favour of the buyer.

    Paypal said I could appeal, I did and within minutes they rejected the appeal.
    So, I wasn't going to waste my time and argue with them, I immediately opened a dispute with FOS http://www.fos.org.au/ stating why I was opening the case.

    I said I wanted the funds back plus the cost of a stat dec form I purchased from Australia Post (will explain soon) the form was only $2 but…..

    2 days later I had the funds (+ $2) returned to me.

    Now, this is what I did (& highly recommend) when I picked the package up from the post office (I use a PO box) I opened the package in front of a member of staff at the post office.
    When I saw the item not as supplied, I asked what the staff member thought. They agreed it didn't look right. I asked if they would complete a stat dec saying as much. To which they agreed, hence stat dec purchase.

    In your case, I would also show the screenshot (& any other proof you have) when opening in front of a witness to back your claim up.
    This will add weight if you need to dispute via FOS.

      Is there a link to the $2 form that I could purchase from Australia Post? I found this link but it says "We don't process forms, verify content or perform identity checks as part of our signature witnessing or document certification service."

        Don't think there's a link for the form sold at AP, you just get it ove the counter. There are free ones on the internet but considering the staff were willing to help, I didn't mind paying (well, Paypal ended up paying LOL)

        Our PO staff are friendly, you probably need one like that to co-operate without issue but really, they cannot refuse as they are legally allowed (just like using a JP) to complete such things where there is issue with a package delivery.

        Yes, FOS do all the work once you start the dispute. I've gone to them a few times with Paypal issues and all resulted in payout. Ignore anything Paypal tries to tell you such as "this is the result, nothing more you can do" it's all to try and protect themselves and total rubbish.

          Awesome tip! I sold a product, the buyer did not like it and filled "not as described" saying it is broken. He sent me back the item intentionally damaged + wrote a rude note on the packaging.

          PayPal of course decided to his favor. Wish I would knew

  • Having PayPal recently ruling against me as a buyer, my conclusion of how they rule is:

    1. If seller has funds in account to freeze and return to buyer, favours the buyer.
    2. If seller hasn't funds in account, PayPal favours the seller.
    • I have transferred all the money out from paypal. Now I have a negative balance!

      • Ouch. I had to do a CC chargeback as a buyer, so I take it my seller will also cop this.

  • Paypal finally replied that they will do the refund once the buyer sends the item back in an original condition.

    I got some markers in the item. Now, how can I proof if it wasn't my original item / original condition? There are some comments about involving post office but the item will be delivered to my house (instead of PO BOX as suggested in above post)

      Such pricey hardware doesn't have a serial number? Or Mac address?

      • I was wondering the same, nothing on the case.

    • When package arrives, see if a neighbour will witness opening.
      Also take photographs.
