Buying 2nd Hand games, what are my rights?

hey i'm new to ozbargin (to posting) but i recently bought a 2nd hand copy of gta V and before the purchase i asked if it was in 100% working condition. when i got home i discovered an issue the game freezes i've followed instructions online about it could be a system setting so i configured them yet the game still freezes.
I've contacted the seller and he has not yet replied
I found this copy through GumTree

What are my rights, what can i do to ensure i get a refund/money back

    • Obviously if it doesn't work he has the right to get a refund. For example if the CD is scratched.
      Question is, will the seller care? Probably not.

        • If the seller knows that the product is not working - then it is obviously fraud….

        • well i'm assuming he knew it wasnt working but i didn't until i got home and started it on my playstation. he's no longer replying to text messages

  • Depending on the company, most places will let you return it for a refund or replacement. EB Games, JB Hi Fi, Cash Converters would all replace/refund it.

    Unfortunately, buying through Gumtree, it makes it much more difficult, since it was a private sale. I've heard some bad stores of purchases through Gumtree/ebay and similar… unfortunately that's the risk you take when you shop on these sites. I would hope that this gets resolved, but it depends on the seller.

    Is the disk scratched or dirty at all, including fingerprints? If you don't know how to fix them yourself, you can take it to EB Games etc and get them to polish/repair it for a small fee, about $5 I think.

  • If you're buying from a private seller from Gumtree, you're basically giving up all warranty and stuff.
    Seller 'should' give a refund, but I dont think there's anything you can do to force them to - that wont cost you more than the items worth anyway.

  • its depend on the seller, I bought a lot of games from gumtree some from mums and dads and couple of times had problem with the game such as something missing or not working, they were happy to refund me and some of them they told me to keep the item too.

  • People just come and go on gumtree.

    I brought a broken PS2 game on ebay. And the seller gave me a refund cause they need their reputation to be good.
    I later brought something else from that seller and it turned out ok and I gave a good reputation for them.

    swap it around

    or

    buy a copy, return the faulty copy as not wotking
