not after reading the contract of sale they expect you to enter, this is one deal that i dont think they would honour :(
Well they want a minimum deposit of $3000… So yeah I think I'll sit this one out. It looks like when you add an accessory it removes the cost of the car and charges only the on road costs.
TERMS AND CONDITIONS
The Customer and Seller agree as follows:
1.1 These terms and conditions together with the Details and any Special Conditions constitute the Contract of Sale ('Contract') between the Customer and Subaru (Aust) Pty Limited ('Seller') relating to the motor vehicle and accessories ('Motor Vehicle') described in the Details.
1.2 The Drive Away Price may be varied if before the delivery of the Motor Vehicle, there is a change in the manufacturer's recommended retail price, statutory charges or applicable taxes and duties. The Seller shall give the Customer written notice of any variation in the Drive Away Price. If the Drive Away Price is varied pursuant to this clause the Customer may rescind this Contract any time within three (3) days after receipt of written notice of the Drive Away Price variation by notification in writing to the Seller.
1.3 If the Customer so notifies the Seller that the Customer no longer wishes to be bound by this Contract the Customer will no longer be bound by this Contract UNLESS not more than three (3) days after such notification the Seller notifies the Customer that the Seller requires the Customer to purchase the Motor Vehicle for the Drive Away Price as shown on the front page of this Contract exclusive of any variation in the Drive Away Price notified to the Purchase pursuant to clause 1.2.
2.1 The Seller shall endeavour to acquire the Motor Vehicle by the estimated delivery date, but shall not be liable to the Customer for any damages or loss whatsoever arising either directly or indirectly from any delay in the delivery of, or failure to deliver, the Motor Vehicle.
2.2 The Customer shall take delivery of the Motor Vehicle at the premises of the Subaru dealer nominated by the Customer ('Dealer') within (7) days of the Seller notifying the Customer that the Motor Vehicle is available for delivery.
2.3 If the Motor Vehicle is not ready to be collected by the Customer thirty (30) days after the estimated delivery date, the Customer may by notice in writing to the Seller rescind this Contract.
3.1 Subject to this clause, the Customer will pay to the Seller, before taking delivery of the Motor Vehicle, the Drive Away Price less any deposit paid by the Customer to the Seller. (Final Settlement Amount Owing).
3.2 If the Customer intends to provide a trade-in vehicle which the Dealer has agreed it will purchase, the Seller agrees that it will accept in part payment of the Drive Away Price the amount the Dealer remits to the Seller for the trade-in vehicle.
3.3 Until the Seller has received payment in full of the Drive Away Price, title in the Motor Vehicle shall not pass to the Customer and the Customer shall hold possession of it as bailee only.
3.4 Subject to any statutory rights the Customer has in relation to returning the Motor Vehicle, while the Customer holds possession of the Motor Vehicle as bailee the Customer:
(a) is responsible for its proper care and maintenance; (b) is liable for any loss or damage occasioned to the Motor Vehicle; and (c) will indemnify the Seller against any claim arising from its use.
3.5 Where the Seller is entitled to reclaim possession of the Motor Vehicle, the Customer authorises the Seller, it's servants and agents to lawfully enter the Customer's property for the purpose of regaining possession.
4.1 Where the Customer requires finance to be provided for the payment of the Motor Vehicle, the Customer shall promptly provide the Seller and/or the financier with information necessary to allow a determination of the Customer's finance application.
4.2 Where the Customer advises the Seller before entering into this Contract that he/she requires finance to be provided for the payment of the Motor Vehicle and having taken reasonable steps has been unable to obtain sufficient finance, the Customer may within a reasonable period (being no more than 14 days) by notice in writing given to the Seller rescind the Contract.
5.1 Where the Customer refuses or falls to take delivery of the Motor Vehicle other than under the cooling off right under section 29CA of the Motor Dealers Act 1974 (NSW) applicable to this Contract (Cooling Off Right) or is otherwise in breach of his/her obligations under this Contract the Seller may terminate this Contract by written notice to the Customer.
5.2 If that occurs, any deposit paid or payable by the Customer to an amount not exceeding 5% of the Drive Away Price of the Motor Vehicle shall be forfeited to the Seller. Both parties acknowledge that the Seller shall be entitled to claim by way of pre-estimated liquidated damages from the Customer an amount equal to 5% of the Drive Away Price less any deposit forfeited.
Where this Contract is lawfully rescinded (other than by exercise of the Cooling Off Right), the Seller shall refund any monies paid by the Customer. If the Customer has sold a trade-in vehicle to the Dealer, the Seller will assist the Customer in seeking to have the trade-in vehicle returned to the Customer by the Dealer.
If the Customer is entitled and duly elects to terminate this Contract under the Cooling Off Right:
7.1 the Customer is liable to the Seller for any damage to the Motor Vehicle while it was in the Customer's possession, other than fair wear and tear;
7.2 If the Customer has sold a trade-in vehicle to the Dealer, the Seller will assist the Customer in seeking to have the trade-in vehicle returned to the Customer by the Dealer;
7.3 the Customer (if the Customer has accepted delivery for the Motor Vehicle before termination) must return the Motor Vehicle to the Seller unless the Customer is not able to return it because of a defect in the Motor Vehicle, not caused by the Customer that has rendered the Motor Vehicle incapable of being driven or unroadworthy in which case the Customer must permit, and the Seller must arrange for, the collection of the Motor Vehicle; and
7.4 any 'tied loan contract' within the meaning of the Consumer Credit (New South Wales) Code is terminated and section 125(2)-(6) of that Code applies to that termination as if it were a termination referred to in that section.
Any addition to or variation of these terms and conditions will have no effect unless signed by the parties to this Contract.
This Contract is governed by the laws applicable in the State of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
Having pasted all that, I'm happy to drop $3000 on this investment.

None of those apply as it's a pricing error. Your argument is invalid.
Pending acceptance means that they have NOT entered into an agreement.

Thing is (as someone pointed out), technically the RRP is NOT changing, thus making this part of the contract null and void anyway.

I put down an order for 2 in good faith. These will be our 8th & 9th Subsides. They are awesome cars. The fine print allows for a change in official RRP - happy to cover that.
In other news…. BRZ RRP to increase by an unprecedented $46K
The advertised RRP was 39k on the 22nd Dec 13. Subaru applied a discount when i placed the order - this does not change the advertised RRP for the day. If Subaru raise the RRP by $46k they will not sell any.
Just double checked on Subaru Australia web site the RRP is $37,150 drive away for the base model - same price as yesterday.

You seriously thought Subaru are going to honour a $799 sports car? Can't believe anyone would put a deposit on this thinking anything would be forthcoming. It's pretty clear it's simply a technical glitch with their website.
What ever you need to do and say to justify your actions, this is clearly a desperate attempt to get something for nothing. It really is disgusting behaviour.

I'm pretty sure you don't get any credit card points for a refunded purchase, unless instead of reversing the charge on the card they pay you by cheque.

If they have on the contract "pending acceptance" along with the company saying they will fully refund you for the deposit means they did not accept the contract… or am i being an idiot?

Just received a phone call from my nominated Subaru dealer congratulating me on the purchase of my new car/s.
Explained that Subaru had indicated a pricing error and the deposit was going to be refunded - apparently this is not the advice sent to the nominated dealers.
