Has Anyone been sold a second hand server as new from MegaBuy?

I had recently purchased a ML110 g7 server from MegaBuy.

I've installed it in a remote office and it seemed to work okay. About three weeks later, it developed a fault and we've called HP for a warranty repair.

They've said that the server is out of warranty and expired in July 2013 (I purchased it it in the End of September 2013).

The invoice and description online did not indicate anything was second hand.

Ideally, I'd like the server to be repaired and the warranty extended. Apart from getting a charge-back from the credit card, is there something else that can be done?

    If there was nothing to indicate that it was second-hand, you would appear to have a good case to show misleading and deceptive conduct on the part of Megabuy.

    Secondly, Megabuy AND HP may have an obligation to repair or replace (and in MB's case, refund) as they may be in breach of the consumer guarantee that goods be of an acceptable quality. Acceptable quality takes into account what would normally be expected for the type of product and cost. If the server was such that a reasonable person would expect such a device to last without a fault event for, say, two years, then both retailer and manufacturer would have obligations under Consumer Law for 2 years from the date of purchase.

    There are other consumer guarantees as well. If the box or any advertising stated that the product had a warranty of 12 months, then to deny warranty would be to breach the consumer guarantee that the product match its description.

    • The whole reason I purchased a HP Server and iLO, raid, etc, was the next business day onsite repair / warranty.

      The online documentation and warranty indicate 12 months next business day response and there is big sticker on the server with numerous locations to call in Australia and a bunch of countries in South East Asia.

      I could have bought two or three RTB clones for the same price.

      iLo was meant to help with remote software, repairs, SSD RAID1 with spare + local-backup and cloud-backup was meant to help with recovery. I guess I was really expecting Next business day repairs for hardware and to extend the warranty before it expired. Didn't expect to have no warranty.

      It's going to cost quite a lot to air-freight it back from where it is now.

      I'm restoring a full system image and pulling key data from the cloud. But the remote office can't really run the software in the cloud for extended periods of time due to (frequent) intermittent network outages and latency. Azure and Amazon are pretty pricey for 8gb ram, 4 cores running 24x7x365.

  • The date on the Megabuy invoice is the start date of your warranty.
    Just tell HP that and if necessary, scan and email them the invoice.

    • According to HP it was registered and warranty activated back in 2012.
      A HP Care Pack was added in July 26 2012 and it expired in August 24 2013.

      Not sure how/why a care pack would be bought and added to a server that was sitting in a warehouse.

      Very annoyed at getting sold a second hand server with an intermittent fault.

        • I've sent them an e-mail and contact form yesterday with my contact number and order details.

          No response.

          Gave up on the phone after 10-15 minutes on waiting. Not keen on wasting mobile minutes forever…

    Thats less than satisfactory service from HP, those servers are brand new and have onsite support, they were a bargain, but they are all brand spanking new.

    Forward me an email from HP? or do you have the details of the person you spoke to? I'm happy to talk to them for you.

    we've had instances in the past where Vendors palm off customers, because their service reps dont feel like doing their jobs.. its disappointing.

    I expected onsite warranty support - the main reason for buying a server rather than a home-brew desktop.
