  • Just got my paypal refund and this after I asked for an explination why they have it in stock.

    "I appreciate the disappointment caused by the cancellation of this order.

    This was a great bargain which led to an extraordinary demand. Regrettably, this demand exhausted all stock very quickly and has resulted in us being unable to fulfill you order.

  • This really is worthy of an ACCC complaint simply because:

    1) They advertised a 'clearance sale', when it wasn't really (as they still have stock)
    2) Took a limited (probably small) number of orders
    3) Had the ability to limit orders on their website and didn't
    4) Had the ability to defer processing of paypal payments until the time of shipping/confirmation of availability and didn't
    5) Lied to the customers by telling them that they couldn't get stock, when they clearly still have stock

    I've pointed out Section 56 (2) of the Trade Practices Act to them, which says "A corporation that has, in trade or commerce, advertised goods or services for supply at a specified price shall offer such goods or services for supply at that price for a period that is, and in quantities that are, reasonable having regard to the nature of the market in which the corporation carries on business and the nature of the advertisement".

    Section 56 of the TPA is called Bait Advertising and is there to specifically stop a situation like this where someone will have a 'clearance sale' to attract cusomters, but only provide a couple of items under that sale & then happily offer unlimited copies of the product at full price to later customers that visit them.

  • I got the same reply regarding the reasons for the cancellation. Of course it didn't address any of my points. What's even better is that the reply to me starts with "Hi David" when my name isn't even David! lol copy and paste anyone? I can imagine how many emails this guy (Keith) is writing to their 'customers'. Also he clearly states that "the contact number of CD WOW is no longer operational." I reckon it's either been inundated with complaints/abuse, or they know what's coming and are getting in early.

    Either way these guys are terribly dodgy.

    After I emailed them regarding the title appearing in stock under a slightly different name, this is the outrageous response:

    "Thank you for your e-mail and sorry for the inconvenience caused.

    Please be advised, we are an international company and we source items from various suppliers based worldwide. The title which is listed in stock on our website at a different price is sourced from a different supplier.

    Again, please accept my sincere apologies for all the inconvenience caused by this order."

    One of the appeals of CDWOW is the many fantastic deals we make available to our customers, across our domains. Accordingly, some promotions exceed expectations very quickly – so much so that our sites may be unable to update our stock holding (or absence thereof) quickly enough to identify shortages.

    We do acknowledge that customers are increasingly agitated at missing out on a great deal, though we also seek and encourage customers to appreciate that we operate on limited (albeit substantial) stocks for these promotions.

    CDWOW MUST fulfill the order since they charged us.
    Here is a very similar case - people buying Dell 250GB HDDs for $8.80, credit card being charged for that amount and then Dell refusing to fulfill orders. Dell lost after the ACCC came after them. Heh.

    Please refer this email onto one of your supervisors, perhaps Michelle.
    The supervisor can then make the decision whether or not to fulfill the orders.
    However, if not, I promise you an ACCC complaint will be lodged.

  • I put in an enquiry with Consumer Affairs, Victoria, and they gave me a call. Informed them of the situation and she asked if this was the first time or if they always do this. I told her i couldn't tell her that as it was my first time dealing with them. I said there are alot more people who are in the same situation. She said if she received more complains and if this was not the first time, she would be keen to investigate.

    I also mention they changed the name of the product etc.

  • My order was cancelled and money returned. This is clearly bait advertising and worth the time to complain to the ACCC

  • just wondering, what is the difference between this cd wow incident and the dell $400 computer incident late last year?

    • In the case of the Dell deal they didn't deduct peoples credit cards, they removed the deal as soon as they became aware of it, and they didn't lie to people by telling them that they were cancelling their orders because they didn't have stock. I still think Dell did the wrong thing but CD Wow are trying to get aware with far worse.

    • That just makes the bait advertising more successful, let a few copies go through, so people can tell others about how this deal is completely legit. Everyone's reactions may seem a bit over the top to some, but I don't think they are. This was a massive stuff-up by CDWOW, and their incompetence will now earn them a reputation.

  • I also have had my paypal account recredited with the purchase price and I have sent a complaint to CDWOW and got a lame response. I then complained to the ACCC. If enough people complain to them them they will take action.

    Just heard back from the ACCC. Unfortunately they won't be able to get CDWOW to honor my order but they will try and stop CDWOW from doing that dodgy trick again.

    I just had a call from the ACCC, their advice was to either take the matter to the small claims court (forcing them to honour their initial price) or buy it at the new inflated price and claim the difference at the small claims court. Both methods seem a lot of hassle for not much gain.

    But…… make sure that you lodge complaints with the ACCC, all you need to do is a quick few sentences on the following form http://www.accc.gov.au/content/index.phtml/itemId/54217#h2_3… , if they have enough complaints they can take action against them. The ACCC lady said that my complaint was the only one she could see in the system at the moment (there must be more complaints working their way through the system from reading above though), make sure you complain so that they can't try and pull this stunt again.

    Thank you for your email of XX March to the Australian Competition & Consumer Commission (the ACCC) regarding CD WOW's retail of Need for Speed.

    The role of the ACCC is to enforce the Trade Practices Act 1974 (TPA), which is designed to encourage fair trading and discourage anti-competitive conduct through a specific set of competition and consumer protection rules.

    The general prohibition under section 52 of the TPA prohibits conduct which is misleading or deceptive, or which is likely to mislead or deceive. Whether conduct is held to be misleading depends upon the circumstances in each case and, in many instances, is subject to a degree of interpretation. Specifically, section 56 of the Act prohibits a corporation from advertising goods or services for a specified price if it has reason to believe that it will be unable to supply those goods or services at the specified price for a reasonable period.

    The Courts have provided further clarification of what might be considered bait advertising. In Wallace v. Walplan Pty. Ltd. (1985) 5 FCR 315, Spender J of the Federal Court Australia (‘the Federal Court’) interpreted bait advertising as being:

    " ..the advertising of a product or service at a special price which the advertiser does not intend to honour. The advertiser intends that the advertised product or service be unavailable at the special price or available at that price only in quite limited quantities. The purpose of bait advertising is to entice customers to the place of business of the advertiser where they might be persuaded to purchase other goods of the advertiser or induced to purchase goods similar to the advertised bargain but at a higher price…The deceit of the advertiser is in causing the prospective purchaser to seek the advertised bargain, which in a practical sense does not exist."

    This interpretation suggests that in order for a business to have engaged in bait advertising, they would be required to have advertised a product on special, which consumers would consider to be at a ‘bargain’ price. The purpose, as opposed to the effect, would be to entice customers to their business with the intention of not supplying, or supplying in insufficient quantities, the advertised product, but instead try to induce the consumers to purchase another more expensive product.

    The conduct that you describe may raise concerns under these provisions of the TPA. For this reason I have lodged details of your complaint in our confidential national database.

    The ACCC’s consumer protection focus is on national issues and local issues that have wider public interest implications. In determining both of these, the ACCC closely studies the patterns of complaints that it receives to ensure that its enforcement actions are focused on the areas of greatest concern to Australian consumers. Your complaint is an important part of this analysis. While the ACCC will not be pursuing your matter further at this stage, the details of your matter have been recorded and will be used to determine whether there is a pattern of behaviour by a particular trader or in a particular industry that raises broader concerns. When such a pattern is established the ACCC undertakes a combination of enforcement, compliance and education activities in order to rectify the problem.

    Whether particular conduct contravenes the TPA is, ultimately, a matter for a Court to determine. To facilitate that process the TPA confers the right of private action on those who believe they have suffered loss or damage as a result of the offending conduct. While it is unclear whether the ACCC will pursue this matter further your private rights to action will not be affected. Should you wish to pursue this option, you should contact the Victorian Consumer Affairs Department on 1300 558 181 and seek advice in relation to the process and costs involved.
