Your Experiences with QLD Small Claims Courts? (Samsung TV)

So this might be an ill-fitting post for OzBargain, but this all came from a deal I got here anyway so technically it's your fault I'm in this mess :)

Samsung has sold me an absolute shitter of a TV. The voice assistant is awful, and the overall quality is very lacking. For a $4000 (down to $1400!) TV, any reasonable person would expect more. I believe I have a decent case for false advertising, as many of the promised features are unavailable due to "hardware limitations", so we'll see how it goes.

I'm planning on taking them to the QLD small claims tribunal, QCAT. Have any of you lot taken a company to court for something similar?

Just about every Samsung deal has one person mentioning how they've been wronged by them. Hopefully I can bring some justice to the OzB community.

        Shame - it has excellent reviews online. Was it a refurb/second?

        • The reviews were what hooked me, but in hindsight, I should have spent what was an extra $200 at the time for the QN90B. It was brand new actually.

            Let me see if I got this right.

            You got a bad Samsung TV that doesn't meet your expectations.

            So much so that now you are taking Samsung to QVAT.

            You think Samsung has wronged every one of their customers.

            And with the benefit of all this hindsight……you would have bought a more expensive Samsung TV?

              @tsunamisurfer: No. I don't think Samsung has wronged every single customer, nice strawman though.

              The reviews for the QN90B were much better than the QN85B, so who knows.

              I think all companies should uphold the promises and guarantees they make. $1400 is not pennies for me and I'll not settle for a blatant misrepresentation of the product I've purchased.

  • They will likely just give you a refund before it goes to qcat. Would cost them more to send a representative and muck around.

  • QCAT is an interesting choice. I'm surprised you haven't looked at ACCC or even QPAC, although I don't see how that drama would play out. lol

    Some aspects of your post seem more suggestive of buyer regret or change of mind.

    • I did submit complaints to the ACCC and OFT but unfortunately neither went anywhere as Samsung didn't respond. Go figure lol

      Thank you though. I'm just doing some preliminary research at the moment (hence the post). In terms of cost and effort, QCAT seems like a relatively safe way to resolve the dispute.

  • Voice assistant is crap my OLED also doesn't work properly, unless your saying you purchased the tv to use the voice assistant… and overall quality is lacking… Care to elaborate?

    • I've found the picture quality to be average. Significant blooming around whites and poor black levels despite local dimming. There's an awful viewing angle due to the high glare of their ips panel. These are personal qualms, and by no means the reason I plan to dispute.

      I didn't purchase the tv purely based off the voice assistant, but it is an important feature which they advertise prominently. There are multiple features stated as fact on their website that aren't available on the TV. Had I known my $50 Amazon Fire TV would function better than this tv, I would have just purchased a Hisense u8g.

  • Please report back if you do go to QCAT and the outcome. Very keen how this goes and if Samsung send someone out, or if no one from Samsung shows up do you then have to pay for bailiffs to go over to Samsung HQ and get the $$ from them? Like that show in UK where people hail high court guys to recover debt.. will be interesting I think!

      So I didn't end up going to QCAT, I just let it sit for a few months. They ended up giving me a full refund with no return in Jan :)
