Sold Defective Samsung Galaxy S6 Seller Refused The eBay Return Do I Open PayPal Dispute or Wait for ebay?

Here's the situation i bought a used Samsung galaxy s6 end of December after i received it i didn't notice anything wrong with the device till i took one picture of a white surface (my old phone to sell) it was very clear that it was there, the dot looks like dust or a defect on the camera lens or something not the outside of the phone either.
Today i opened up a eBay return and now the seller refuses the return.

do i open a pay pal dispute or wait till the 14th so that i can ask eBay the step in?
Note in the eBay return i have included three images two taken by the phone with the dot circled in one image to show the dot and the other not circled both different images as well.
A third taken by another camera of the Galaxy s6 with the camera open with once again the dot visible and in the same spot.

    What do you mean?

    Did you contact the seller before doing the return?

    Just contact them explain the problem and see what they say. If that doesn't work you can request a return and a refund through paypal and the seller normally doesn't get to say "yes or no" it usually goes in the buyers favour.

    • Ebay has a feature called ebay return it allows pretty much what you said but instead of messaging the seller it shows all the messages back and forth in one page and allowed photos to be uploaded from both sides. and after the 14th i can ask ebay to step in.

      or i can open a paypal dispute right now and let paypal sort it out.which ive done in the past.

        • The listing said no returns as all listings do just about.
          and she says she has pictures taken from the device before she sent it.

          Im not sure how much i trust the images though as the two she posted both have different image size 16:9 and 4:3
          the 16:9 one which has the date it was take also has the same bar at the top which is from iphones.

          If the item is defective then she has to.

          Can you post the images on imgur or similar ?

          eBay will likely side with you and not her.

      So they didn't list any faults like this which is a pretty big fault as it devalues the phone big time when i go to sell it later on which i wasn't planning on.

  • buyers should always contact the seller before opening a dispute. this seller has now received a defect for this transaction. this will make the seller reluctant to help and may only do so if ebay/pp forces their hand.

    • I haven't opened a dispute, I am asking should i open a seller dispute now that she refuses to refund me for a defective item.

          Any return request for an item not as described will count as a defect.

          I'd actually like to see a photo of this, it's very common that second hand items have scratches on them, and they often end up on the camera lens…. You didn't expect that to happen?

        • @Mattwilko: The phone when i got it still had the plastic film on the camera which i only removed after searching online about this problem some said that it was the cause so i removed it but it's still there.

          the plastic stuff is still over the flash part though.

          It's used, what do you expect. Honestly, it may not be perfect and you're not entitled a perfect phone LOL.

          The seller isn't like a shop and should not have to deal with such picky buyers.

          I agree that if a phone is used you're not entitled to a perfect phone but all defects should be clearly listed in the product description before purchase - you should know exactly what you're buying.

          Interested to see how this pans out. To me, the camera works but has a little cosmetic blur in certain scenarios.

          A picky buyer may also complain that there is another slightly observable scratch at x, etc etc. Would go on forever.

        • @Forenti: well said. The pictures of the outside where good but. Half a sentence description which basically said condition.

          I bought it knowing the type of phone it is and the physical condition not told about any internal issues.

    Its samsung galaxy s6s their BAD. even NEW ONES ARE BAD!!! ram problems, software problems! crashes and what your getting now my friend has that problem! she lives in the USA so its everywhere, you shouldnt of gotten a S6 in frist place most are faulty well ALL ARE.

    I would imagine you would have problems claiming this on warranty from 'some' retailers if this was a brand new phone, yet your trying to pull this on a second hand seller of a used phone. You clearly have no soul.

      You might. Like buying items with unknown faults but I don't and would like my 500 back so I can buy a non fault one from a non scammy seller.

    No matter how ridiculous this sounds but the OP will get his money back if claimed in eBay.

    PayPal might not side with the buyer but eBay claim would (unfortunately) allow virtually any buyer to return the item to the seller and the seller needs to pay for the return postage. If you open PayPal claim, buyer is responsible to pay for the return postage.

    • I don't have a problem paying for postage I've done so for. Other PayPal disputes before.

    The seller has an obligation to notify the buyer of any defects with an item. If you get no joy from either eBay or Paypal, refer your complaint to The Office of Fair Trading in your State or Territory. Good luck!

    it seems the camera defect might be a major point; if this was concealed the seller might be morally in the wrong; buyers caught by such sellers need our support not our condemnation.

    Not correct, what a previous Oz Bargainer suggests. You are now protected by Paypal's guarantee to reimburse you for return postage should you return this defective thing to buyer - you are entitled to claim 8 times return postage (maximum) a year, each time not exceeding $45 postage. (But you must have paid via Paypal and in full) If you intend to claim return postage from PayPal, I suggest you do the entire claims process via PayPal. It's one or the other. From past experience, I found that Paypal refunds faster than the Ebay process, ie of course if they found you have a valid case and find in your favor. Also, the full amount of reimbursement always includes the postage to bring the item to you, so you are not a $ short. Must mention that you were sold a faulty product not mentioned or described in the listing and had you known, you would not have purchased, likewise not have paid postage to bring it to you. Therefore you are entitled to refund for that initial postage cost as well as the return postage. Your problem now is to get the seller to accept a return, and since he/she won't, you need EBay or Paypal to arbitrate because you cannot post back item if seller refuses to accept returns.

    Phone has been returned and refund is in progress should get it back in a few days.

    Funny thing is i saw the same phone listed on a different ebay account yesterday they still didn't list the camera defect and someone else has bought it.
    I know it's the same phone from the pictures and the location is the return address i was given.
    This situation with dodgy sellers is the reason eBay protection and paypal protection exists.
    I now own a brand new Galaxy s6 edge white from the jbhifi deal with no defective camera.
