What Are My Rights as a (Pet) Buyer in NSW

Hi all, I have purchased a Cavoodle with a registered breeder yesterday.

Due to a change in circumstances I want to return the puppy to breeder and breeder is refusing to pay any percent of amount that I paid.

I would like to understand what my rights are here. Many thanks for your input here.

Thank you

the dog is now second hand, Value takes a significant hit.

The dog depreciates as soon as you drive walk it out of the lot

Not sure why this isnt the top rated comment. Any good breeder would easily take a puppy/kitten back within a reasonable amount of time. Seems like OP bought their dog from a puppy farm and now the seller doesnt want to give them a refund.

    • They wouldn't be a registered breeder with the ANKC or Dog's NSW (unless they operate differently but crossbreeds aren't recognised).
Either way it's poor form, most registered breeders care about the dogs for the life of the dog. I know many that rehome older dogs when peoples circumstances change

I think most of OzBargain will agree that OP should give me the dog.
How does Henry sound for a name?

    • +1

Good name for a bully terrier.

      • +2

I think it would suit a confident cavoodle that just wants to teach the other small dogs not to be wimps…

  • +1

Did you have a contact for the sale? What does it say? What circumstances changed?

  • +3

Poor dog. How does your circumstances change less than a day later? This is a big decision so I'm sure you didn't just drop $5k without thinking about it…

  • Take it to the court of social media. Post and honest review of your experiences and see what happens.

Poor dog. Clearly you haven't thoroughly thought about that before getting 15 years commitment animal.
If you cannot keep the dog anymore. Get him/her/they a new love home, give it to someone who loves and can take care. I am open as I have a retriever at home.

Please don't think about the money and psychologically ill- treat the dog.

  • A dog is not a commodity.. its is a lifetime commitment. Why did u buy the dog in the first place? Since it’s a caboodle, you won’t have any problems finding deserving fur parents who can hopefully understand what it means to take on a living pet!

  • This is outrages, to channel 7 you should go.

Joke aside, I'm curious on how your circumstances has changed.

      circumstances has changed

Bought a cat and couldn't return that either.

    • I reckon you’re going to have to roll a 20 to get that answer.

    • Probably bought the puppy for someone's surprise birthday present but it turned out she HATE it in the end

  • +3

    Didn't save the relationship then?

  • +2

Hey mate I’m in Sydney and can take the dog for free if you need

    • I’ve got first dibs…

      • +1

        Hey! I'm closer! ;)

        • I’m more dedicated…

  • +1

I want to fight you - 1v1 at the dog park right now!

  • +1

Where are you located? Some of us are in the market for a Cavoodle.

Flipping puppies for a profit would generate a whole new level of OzBargain hate.

      • +1

        Flip Pancakes, not Puppies.

  • +1

please just give the dog to a good home

  • Why did you change your mind? If it was because you found out the puppy had down syndrome or something like that then fair enough. But if there isn't any extenuating circumstances then I think you're out of luck…

  • Since OP is not getting any advice, I guess he should just put the dog down now

  • +1

OP looks like you have some rights according to law. I think this thread is a good example of the crowd that hangs out here.

  • +1

Hoping this is a troll post otherwise it sounds like OP did no research about owning a puppy then got a bad nights sleep from their puppy crying. Owning a puppy is not easy but it's just morally wrong to not do thorough research before purchasing an animal. I hope this is a troll but if not may that puppy find some competent loving owners.

There are no such thing as a registered breeder of cavoooodles.
Just another dirty backyard breeder scammer I am afraid.

See if you can find a reputable rescue group who may adopt? NOT rspca.

If FREE typicaly means it will be used in a dog fight and killed.

    • See if you can find a reputable rescue group who may adopt? NOT rspca.

Don't think the OP gives a toss about what happens to the doggo, the concern here is about refund rights.

  • +2

Nothing OP is saying makes sense.

You bought a very expensive dog without the proper consideration. This indicates that money is not a concern for you. Now you wish to return the dog, and are concerned about the money…? If the money mattered to you, you would've given your very expensive purchase more time and thought. A dog is not a Christmas toy. A dog is forever. In some ways it is just as difficult to take care of a dog as it is a small child (which I'm sure you now understand all too well). Part of me is hoping OP's post is a joke.

In any case if this is a legit post, please do the right thing and re-home the puppy to a good home.

    • I thought it was a 1st years homework assignment.

  • Give the dog back. Take the L on the refund and learn that you're clearly not fit to be a dog owner.

  • +1

Was the dog a lemon or is OP the lemon?

    • +3

My money is on the OP

  • Unfortunately, there are some people like this that also get married and have children and their "circumstances change" in a few days.

  • Trade and save

  • +1

ill take the dog, if you dont want it!

  • Cant stand ppl like you.

  • I’ll take the dog and give it a loving home like it deserves

  • +2

Yeah I'd return that shit dog too

  • “Change in circumstances”

Good on the breeder for not returning you a cent. Learn your lesson and move on.

  • +1

You don’t have “rights”. It isn’t a faulty TV… You bought the dog he/she is now your dog. I could rant for a long time about responsible dog ownership but I’ll give you the benefit of the doubt here as s*** happens in life where you can’t provide the dog with a good home and you have done the right thing going back to the breeder.

Those going on about the animal warfare act, I don’t believe it applies here as it normally applies if the dog is aggressive or has a medical condition that would require extra care. If you have suddenly realised the responsibilities of a dog that you didn’t that is your fault.

Can you provide more info on the circumstances that have changed? Don’t need your life story here but maybe some more details will allow some empathy.

If the breeder is a responsible one they should take the puppy back and offer him/her to someone else on their puppy list. If they can find another owner maybe they’ll agree to a part refund. They don’t have to do this though.

  • People should consider rescuing instead of buying from breeders.
